Vice President, Claims Counsel The candidate will be responsible for conducting legal research as needed to assist claim professionals on individual claim files, evaluate complex or novel policy coverage issues, complete written memorandum on coverage and legal issues, provide guidance and training to claim staff, assist in management of nationwide litigation program and handle assigned caseload consisting of extra-contractual lawsuits and declaratory judgments from inception to conclusion. As a direct report to Chief Claim Officer, provide counsel and advice to senior management. Manage an in-house Claims Legal team, both on-site and remotely, which team provides claims, underwriting and product development legal support company-wide. Manage and directly handle assigned caseload of litigated files involving extra-contractual damages and declaratory judgments. Analyze and provide formal opinions on coverage and legal issues for multiple product lines. Assign outside counsel to represent the company and manages counsel pursuant to company's litigation management guidelines. Manage panel counsel as participant on Panel Counsel Committee, including participating in audits of panel counsel. Act as in-house legal resource for claims department. Manage and control reserves and expenses associated with assigned caseload in compliance with company guidelines. Negotiate and authorize appropriate settlements within designated authority. Prepare case summary reports for review with management. Attend mediations, settlement conferences, court hearings and trials. Conduct legal research as necessary. Provide formal and informal training to all claim staff on legal and coverage issues. Monitor industry trends and provides feedback to senior management and claims department as needed. Assist in drafting and completing claims correspondence. Perform other duties as assigned.
Qualification and Experience
The candidate should have a J.D. degree from an accredited law school. State Bar license is required. Must have 10+ years of related experience as in-house counsel or in private legal practice with an emphasis on P&C coverage-related work (15+ years of relevant experience is preferred). Should have management experience, including coaching and mentoring of staff. Experience focused on property and casualty insurance coverage defense is required. Experience with Declaratory Judgement and Extracontractual litigation is needed. Significant negotiations/ADR experience and excellent negotiation skills is essential.
