Chicago office of our client seeks mid-to-senior employee benefits and executive compensation associate/counsel with 5+ years of experience, with a particular focus on health and welfare benefit plans, including medical, dental, vision, life and accident, flexible spending accounts (FSAs), health reimbursement arrangements (HRAs), health savings accounts (HSAs), dependent care assistance programs (DCAPs), and severance pay plans. The candidate will assist with a wide variety of other employee benefits matters, including mergers and acquisitions due diligence, executive compensation and qualified plans. Should have significant experience advising clients with respect to the Affordable Care Act (ACA), Consolidated Omnibus Budget Reconciliation Act (COBRA), Employee Retirement Income Security Act (ERISA), Health Insurance Portability and Accountability Act (HIPAA), and Internal Revenue Code (IRC) provisions applicable to employee benefit plans. Must be familiar with the Genetic Information Nondiscrimination Act (GINA), Medicare and TRICARE Secondary Payer Rules (MSP), Medicare, Medicaid and SCHIP Extension Act (MMSEA), Mental Health Parity and Addiction Equity Act (MHPAEA), state insurance laws, and the impact of federal employment discrimination laws on employee benefit plans (such as the Pregnancy Discrimination Act (PDA), Age Discrimination in Employment Act (ADEA), and the Americans with Disabilities Act (ADA)). Experience includes reviewing and negotiating administrative service agreements; drafting plan documents, Summary Plan Descriptions (SPDs) and Summaries of Material Modifications (SMMs); advising client regarding participant notices and government filings; and handling Department of Labor audits. Multiemployer and Multiple Employer Welfare Plan experience is a plus.
