Paralegal II The candidate provides a variety of direct legal support assistance services to serviced AUSA and Auditor staff. Reviews and evaluates case referrals to determine the need for additional information and evidence, and planning a comprehensive approach to obtain this information and evidence. Advises the ACE attorney(s) regarding the merits and weaknesses of ACE referrals based upon applicable law, evidence of liability and damages, and potential defenses. Helps the ACE Unit develop new referrals by ensuring a good working relationship with client agencies and the public. Receives and analyzes incoming pleadings and correspondence. Determines appropriate action and notes time limitations for responses. Prepares initial drafts correspondence and legal documents for ACE attorney signature. Prepares initial drafts of proposed orders and decrees for signatures of judges. Researches legal and factual issues and analyzes and summarizes the same. Use automated resources and technology for the development, presentation, and prosecution of federal cases. Use legal research tool and litigative support technology such as digital imaging applications, graphic design software, audio visual equipment, and trial presentation programs. Examines, prepares and processes a variety of technical legal documents that are characteristically voluminous and complex in format. Reviews incoming material and independently determines the need for assembly and preparation of a variety of legal documents, e.g., complaints, motions, orders, answers, pleadings, Civil Investigative, Demands and subpoenas. Obtains needed information from files, administrative and law enforcement agencies, or other sources, and submits completed legal documents to the appropriate AUSA. In preparation of documents, considers the nature and the status of the case involved. With limited instructions from the AUSA, prepares initial drafts of such legal actions as seal extensions, motions and other pleadings. Completes variable aspects of preparing recurring legal documents that conform to the rules governing their style and format. Provides assistance to ACE attorneys in trial preparation by performing duties such as independently compiling trial notebooks, assembling jury instructions, compiling witness and exhibit lists, and managing witnesses. Coordinates with the victim/witness specialist to ensure adherence to current Departmental guidelines relating to victims' rights and services responsibilities. Notifies appropriate individuals of victim/witness issues. Using original and online legal resources, verifies citations and statutory references contained in legal documents. Ensures citations are complete and consistent with source material. Develops tables of contents and indices to briefs in accordance with established format. Lists cited cases, opinions and miscellaneous references in briefs. Composes original letters that require a good working knowledge of legal procedures and specialized terminology, e.g., transmittal of pleadings, requests for extensions of time in certain cases, advising of actions taken or developments in cases referred by other federal departments and agencies, and notices to attorneys representing defendants. Scans/inputs and links case-related materials into an electronic database and manages that database. Manages discovery and trial preparation. Performs legal research using legal precedent, existing legal files, textbooks, legal periodicals, statutes and regulations. Has working knowledge of research software such as Westlaw and LexisNexis. Performs factual research using online resources, journals, periodicals, public records and financial documents. Performs asset searches. Assists in production of exhibits and witness lists, exhibit notebooks, and/or demonstrative exhibits for trial. Assists with preparation for interviewing witnesses and potential complainants concerning violations of federal law. Provides a variety of ancillary office support functions requiring some subject-matter knowledge of the ACE Unit's programs and operations. Typical assignments may include the following: Assembles the physical files for new ACE cases by filing materials in chronological order, preparing and printing conflict of interest sheets for assigned attorney and numbering the initial case materials and/or discovery. Upon receipt, sends additional discovery to outside parties as directed by the assigned attorney. Prepares ACE files for closing by putting the documents in chronological order, ensuring that the relevant documents are in the file, and preparing a closing sheet for the assigned attorney's signature. Answers telephone and refers callers to staff members or takes messages as appropriate. Furnishes requested information concerning pending and closed matters and cases, functions and general procedures of the office. Determines which matters should be referred to the AUSA and the urgency of the matter. Arranges travel by preparing itinerary, and securing transportation and hotel reservations. Prepares travel authorizations and vouchers using automated system. Produces a variety of written documents and materials utilizing a wide range of office software applications. For example, assignments may include integrating output from different software types, e.g., tables produced by database applications and charts and graphs produced by electronic spreadsheet applications, into word processing or desk top publishing text. Products include complicated tables, graphs and charts which may be incorporated into legal documents or courtroom presentations. Ensures all documents contain the proper format, spelling, punctuation, capitalization, and grammar. Provides automated litigation assistance to attorneys in trial preparation and courtroom presentations. Utilizes various software applications and graphics hardware such as scanners and plotters. Prepares documents, charts, and visual materials used in trials. Provides technical support e.g., enlarging charts and photographs, duplicating tapes and videos, and marking exhibits. Paralegal certificate and 5+ years of legal experience is needed. Must be able to pass and maintain Federal Government Security Clearance is essential. Must have knowledge of legal process, document filings and related. Knowledgeable in the use of Lexis and/or Westlaw is helpful. Knowledgeable in trial proceedings, exhibit creation and presentation is helpful. Must be proficient using MS Word, Excel, PowerPoint, MS Access is essential. Strong communication skills both oral and written are a must.
