Boston office of our client seeks technical specialist with 2+ years of experience. The candidate will work under the direct supervision of an attorney or patent agent. Will assist in the preparation of patent applications. Produce claim strategy in view of invention disclosures and materials provided by clients. Draft the specification and claims of patent applications. Draft an amendment or reply to communications from the U.S. Patent and Trademark Office (UPSTO) that may require written argument to establish the patentability of a claimed invention in the U.S. Draft instruction letters to foreign patent counsel to establish patentability of claimed inventions in foreign jurisdictions. Draft communications for use in re-examination proceedings, petitions, appeals to the Board of Patent Appeals and Interferences, or other proceedings before the USPTO. Draft Patent assignments as required. Assist in the prosecution of patent applications in the U.S. and foreign jurisdictions. Assist in the formulation of prosecution strategy for clients’ long-term intellectual property needs. Perform freedom-to-operate analyses on clients’ proposed activities. Perform due diligence and analysis to assess patentability of inventions. Perform due diligence regarding the licensing of patents and patent applications. Assist in managing patent and patent application portfolios. Must have PhD in Biochemistry, Molecular Biology, Molecular Genetics. Experience must include: working within molecular biology, genetics, immunology, model organism biology, development, neuroscience, and transgenics, or related; assisting with managing patent and patent application portfolios, including formulating prosecution strategies; assessing the patentability of inventions; generating sequence listings, including use of USPTO approved software Patent In sequence listing software; planning and performing prior art and sequence searches using publicly available databases and private databases (for example Thomson Innovation or Genomequest); drafting inventor declarations to assist in prosecution of patent applications; drafting office action responses in U.S. and foreign jurisdictions; performing freedom to operate analyses; communicating with scientific inventors and clients; legal writing; performing patentability analyses; and utilizing search engines such as USPTO.gov. Experience must also include drafting and prosecuting patent applications in the U.S. and foreign jurisdictions relating to: cutting-edge immunological technologies, including cell therapies (CAR-T therapies), gene therapies (gene replacement therapies), antibody therapies (antibody engineering); devices, including medical devices, biophysical technologies (flow cytometry), next generation sequencing technology; and pharmaceuticals, compounds, and compositions.
