Counsel - EPC
The candidate will support the day-to-day legal needs of company's Engineering, Procurement and Construction (EPC) business, and work closely with members of the Legal, EPC Sales, Pre-Construction, Engineering, Construction and Procurement teams. Will focus on negotiating and drafting contracts at the center of company's solar energy system construction business, including EPC agreements, PPAs, and a wide range of subcontracts. Drive meaningful improvements in how the company efficiently negotiates and manages its construction-related contracts. Draft and negotiate engineering, procurement and construction (EPC) agreements, operations and maintenance (O&M) agreements, power purchase agreements (PPAs), supply agreements and subcontracts for PV solar and energy storage projects developed and/or built by company. Work closely with internal stakeholders to develop and implement improvements to contracting processes and tools, including a suite of regularly updated template documents. Advise on construction-related disputes and develop and manage process to continuously improve the dispute management function. Manage and supervise outside counsel as necessary.

Qualification and Experience

The candidate should have a J.D. degree and membership in NY, MA, IL, or CA Bar. Must have 4+ years of substantial, relevant legal experience at a top-tier law firm, sophisticated corporate legal department or combination of the two negotiating construction contracts including EPC agreements and PPAs. Track record of implementing process improvements to improve quality, efficiency and risk mitigation is required. Knowledge of laws, rules and regulations relevant to the development and construction of solar projects, including licensing requirements and labor regulations desired. Experience working in a construction or renewable energy company, or with renewable energy or construction clients, including addressing common legal issues that arise with customers and subcontractors an asset. Familiarity with Lean Process Improvement and 4DX principles is ideal.
