Lead Counsel, Employment Candidate will serve as lead counsel to all employment matters across the enterprise providing expert advice and working proactively with key business leaders that instill diversity, equity and inclusion within labor practices. Will manage a broad range of internal partners, including the Chief Human Resources Officer, while collaborating with other attorneys by providing legal advice and counsel on a broad range of employment topics. Will work closely with internal business partners to make a positive impact. You have significant employment and labor law experience and work independently with general direction from the Deputy General Counsel in line with department goals and objectives and the responsibilities and accountabilities of the role. Will provision advice covering both the company’s common law employees as well as members of its field force categorized as statutory employees. As Lead Counsel, Employment, Will manage two direct reports, an incumbent employment lawyer generalist and an incumbent employee benefits lawyer. Will: Provide advice and counsel to management and HR professionals on all aspects of day-to-day employment-related matters, including pandemic-related workforce issues, hiring and termination issues, harassment, discrimination and retaliation, leaves of absence, reasonable accommodations, wage and hour issues, restrictive covenants, conflicts of interest, independent contractor issues, statutory employee issues, employee investigations, hiring of current and former government employees, etc. Investigate and represent the company at the administrative level (EEOC, DOL, equivalent state and local agencies). Prepare position statements and manage outside counsel. Review involuntary terminations and draft separation packages. Partner with litigation team colleagues on employment and labor litigation, reviewing pleadings, developing strategy, facilitating the gathering of information (documents, interviews); making recommendations at key stages in the process, etc. Conduct basic legal research and prepare opinions. Interprets statutes, government regulations, and executive orders; stay up to date on changes in employment and labor laws and provide tailored advice to stakeholders on any policy, process or other change. Provide legal advice in ethics investigations; may be asked to serve as lead investigator in high-level or sensitive matters. Review, interpret, and draft company policies and procedures and, specifically with respect to employee benefit matters, oversee the drafting of benefit plans by our incumbent employee benefits law subject matter expert. Assist in the preparation and delivery of internal training courses on a variety of employment law topics. Assist in company acquisition efforts as needed in areas of subject matter expertise. Develop professional credibility and relationships with internal and external stakeholders as well as manage relationships with outside counsel.
Qualification and Experience
Qualifications: A JD Degree required. NYS bar admission preferred or eligible to be admitted with NYS bar under its in-house counsel admission program. 10+ years of relevant professional legal experience practicing labor/employment law in a large law firm or an in-house legal department. Familiarity with the laws and regulations governing qualified and non-qualified employee benefit plans is preferred. Strong oral and written communication skills as well as outstanding organizational and analytical skills required. Work independently, but collaboratively in a team setting while displaying a high level of self-direction and sound judgment. An executive leader who will build a strong culture of engagement and high performance with direct team and across the Law department. A pro-active leader who brings forward insight and recommendations to address issues before they create legal exposure; able to handle a multitude of complex and challenging situations. Motivated, business-oriented who is client-focused and can successfully interact with the Company’s attorneys, human resources professionals, management and leadership.
