ProfileSenior Regulatory and Product Counsel The candidate will be responsible for working in close partnership with individual business units and cross functional teams to provide legal and regulatory guidance and negotiate bank agreements as Marqeta develops, implements and updates its products and services, and enters into new business relationships. Advise business partners who are working on new and existing products from product development through launch, including compliance advising in relation to such products. Provide timely, concise and business-focused legal advice on payments law, including federal and state consumer and commercial credit and debit laws like TILA and Regulation Z and Regulation E, UDAAP, banking regulations like, BSA/AML, and data privacy and protection laws. Structure and draft cardholder agreements for Marqeta products. Work with banks in developing cardholder agreements. Negotiate bank agreements. Advise and support Marqeta’s marketing professionals, including review of marketing copy and product claims. Instruct and manage outside counsel, as necessary. Handle other matters as required to support the business. Should have a proven high-caliber, experienced, solution-oriented and proactive attorney with experience in the payments space. Deep experience analyzing and advising on a wide range of issues related to the payments industry, with specific expertise on prepaid and credit products are essential. Should have experience with international expansion and payments and credit legal issues. Must have JD degree and 10+ years of experience practicing either in-house (or in an equivalent setting) or at a reputable law firm, preferably with 3+ years of those years focused on consumer or business credit and either payments law or financial services regulatory analysis, and 1 year working in or advising fast paced FinTech start up companies. Should preferably have experience negotiating and drafting complex financial services contracts. Must be admitted to a state Bar.
