Director, Legal Services and Enterprise Risk Management The candidate will join the company team as the agency Director of the Office of Legal Services and Enterprise Risk Management. Will provide funding, resources, tools, data and technical assistance that enable educators to ensure students succeed in our public schools, are prepared to access post-secondary training and education, and are equipped to thrive in their careers and lives. The Office of Legal Services and Enterprise Risk Management is a newly created unit of company's Legal Affairs division, under the leadership of the agency's Chief Legal Officer. The Office will be responsible for supervising the agency's Public Records and Information Governance Program, administering privacy and data share agreement initiatives, coordinating the development of agency policies and procedures, ensuring compliance with Washington's Administrative Procedure Act, performing risk assessments and periodic data security auditing, and advising other programs in the agency on how to mitigate risk through formal policies and improved workflow. The Director of the Office of Legal Services and Enterprise Risk Management will serve as nterprise risk manager, and will be an innovative and highly collaborative leader in the agency. The position will directly supervise a team of three and will work closely with other staff to support compliant and best practices in risk management, records retention, data privacy and security, agency policies and procedures, and public records requests. Lead the implementation of an risk management program, including the agency's cooperation with the Department of Enterprise Services' Office of Risk Management. At the direction of executive leadership, develop and ensure implementation of policies and procedures that mitigate risks to company, including coordinating with other agencies and company leadership to identify risks and develop measures to mitigate them. Research and apply laws, rules, policies, and procedures in the areas of risk management, FERPA, public records disclosure, records management, litigation discovery, and the state Administrative Procedure Act. Oversee and supervise associated risk management programs, including public records, information governance, litigation coordination, privacy and data sharing, agency policy development, and administrative resource services to ensure full integration into enterprise risk and information technology programs. Direct and manage staff charged with gathering, reviewing and releasing public records, ensuring the agency's timely and accurate disclosure of appropriate public records, ensuring compliance with public disclosure laws, and mitigating risks to the agency inherent in the public disclosure process. Direct and manage staff charged with retaining records pursuant to chapter 40.14 RCW (Preservation and Destruction of Public Records), ensuring agency compliance with records retention laws. Act as the liaison to the Attorney General's Office to facilitate discovery in civil litigation proceedings and issue Litigation Hold Notices to appropriate agency staff in anticipation of litigation. Interface with members of the public while supervising responses to public disclosure requests. Strategize, recommend, develop, and implement changes and updates to company public records and information governance rules, policies, and procedures. Oversee agency initiatives to ensure the safeguarding of confidential data through contracting, auditing, interpretation of laws and rules, and establishing and implementing policies and procedures. Oversee and manage company data share agreements to ensure compliance with FERPA and other confidentiality laws. Review company data share agreement audit activity and monitoring functions, and develop action plans or other strategies as needed. Collaborate with company's Information Technology Services to respond to data security incidents, including alerts from the agency Data Loss Prevention system. Conduct training and education for company staff related to FERPA and privacy compliance activities. Collaborate with company's Chief Information Officer in assuring compliance with Washington State Office of the Chief Information Officer policies and state laws. Strategize, recommend, develop, and implement changes and updates to company data sharing agreements. Direct and manage staff charged with coordinating agency rulemaking and adjudicative proceedings under the Administrative Procedure Act. Strategize, recommend, develop, and implement changes and updates to rules, policies, and procedures governing company's compliance with the APA.
Qualification and Experience
A Master's Degree in Business or Public Administration or 15+ years of experience performing comparable work successfully. Law Degree is highly desirable. Professional experience with laws and rules pertaining to records retention, public disclosure, and civil litigation discovery is preferred. Experience supporting litigation-related functions in a public or private entity is desired. Experience planning, tracking, and managing projects is desired. Prior experience managing and responding to complex public records requests is desired. Prior experience supervising staff is desired. Experience presenting complex information to both small and large audiences is desired. Prior experience providing training courses for adult learners is desired. Experience drafting agency policies and procedures is desired. Experience in working and collaborating with multiple racial/ethnic and socioeconomic groups is desired. Must have excellent customer service skills. Should have knowledge of Microsoft Office Suite, including prior work with database management. Must have articulate and diplomatic communicator both orally and in writing. Ability to proofread documents, and provide a high level of attention to detail is needed. Should have knowledge of, and familiarity with risk management principles. Must have ability to communicate, coordinate and collaborate with diverse managers and staff in the agency to ensure understanding and agreement on risk management functions and activities. Knowledge of state and federal laws and rules pertaining to records retention, public disclosure, and civil litigation discovery is needed. Should have Knowledge of state and federal privacy laws. Should have knowledge of Washington's Administrative Procedure Act; Knowledge of the Ethics in Public Service Act is needed. Must have Preparing and issuing litigation holds, collecting records relevant to litigation. Should have ability to think strategically and plan tactically. Ability to resolve problems where competing needs or issues arise is needed. Should have ability to independently analyze, interpret laws, and weigh the risks and benefits in decisions and recommendations related to the principal responsibilities of the position. Must have ability to train individuals and diverse workgroups on the Public Records Act, records retention laws, and other complex legal rules related to agency risk management. Ability to communicate in technical documents and other written formats, conversation, and public presentations to a broad array of educational groups and stakeholders is needed. Should have demonstrated knowledge of the principles of program development, management, and evaluation.
