Chief IP Counsel The candidate will be reporting to the General Counsel of Firm and Molecular Devices and be an engaged member of the leadership team providing support for daily business operations, as well as strategic initiatives. Will be responsible for managing a global IP team and performing a wide variety of hands on legal and business advising. Actively participating in the Legal Leadership Team and advising the firm and Molecular Devices leadership team on legal, intellectual property and business related issues. Providing advice, counseling and implementing strategies for patents and other intellectual property matters pertaining to the development and commercialization of mass spectrometers and other life sciences products and services. Managing the day-to-day operations of the IP group to identify and protect intellectual property rights, including, for example, patent prosecution process, freedom to operate (FTO) issues, patent enforcement, etc. Ensuring that the patent portfolios across the OpCos are aligned with and support the overall commercial and development objectives of the business and that valuable intellectual property is identified and protected. Understanding the competitive IP landscape and counseling the research, development and commercial teams accordingly. Identifying potential IP opportunities and encouraging the creation and protection of IP to ensure the long-term competitive advantage of the business. Collaborating with the commercial legal and business teams to support IP aspects of contracts, litigation, mergers and acquisitions and other complex matters. Operating the IP group within the specified financial budget and any applicable project specific budgets. Managing any patent or other intellectual property litigation, including preparing discovery and management of outside counsel. Managing outside counsel with regular reporting and billing, managing legal spend and driving efficiencies and cost reductions. Monitoring significant changes in laws and regulations and intellectual property trends that apply to the Life Sciences Platform and updating strategies and communicating with the changes and updates to the business teams. Liaising with the senior IP attorneys across Danaher to ensure that policies are followed, information and best practices are developed and shared.
Qualification and Experience
The candidate should have excellent academic credentials, including a Masters or Ph.D. degree in physics, chemistry, engineering or a similar scientific area. Should be qualified lawyer in good standing in one jurisdiction. Should have 15+ years of experience working at both a top-tier law firm and in house in the life sciences or medical devices industries. Experience managing complex legal and intellectual property issues is essential.
