Senior Legal Director, New Business Models and Value Based Healthcare The candidate will be responsible for helping define the structure and operating mechanisms of the new Center of Expertise, and leading and managing the work of a team of lawyers (reporting lines and structures to be defined). Will advise commercial attorneys and business partners in each of firm's Groups, Regions and Functions, and manage risk presented by applicable regulatory regimes, including the U.S. Anti-Kickback Statute and its safe harbors, the Physician Payments Sunshine Act, the Federal False Claims Act, Stark Law, Corporate Practice of Medicine regulations, antitrust laws, and other laws and regulations pertaining to physicians, hospitals, clinics, and the delivery of healthcare around the globe. Also provide legal advice to the firm's Office of Ethics and Compliance and Group and Regional compliance teams. Also collaborate with the U.S. Government Affairs team on relevant policy initiatives. Work with the VP leader and other key stakeholders to determine the optimal structure for the COE. Manage and deploy resources across the organization to advise the Company on legal and compliance issues and risks arising from New Business Models and Value-Based Healthcare initiatives. Identify, anticipate, counsel on and help mitigate key legal risks. Build consensus and develop policy on fraud and abuse and healthcare compliance issues, preferably serving as a subject matter expert. Develop expertise on emerging and cutting edge legal issues facing the Company. Provide day-to-day advice, counsel and training of commercial attorneys, business clients, and other functional representatives. Facilitate discussion and drive consensus regarding resolution of legal and business issues. Retain and direct outside counsel. Coordinate closely with the Office of Ethics & Compliance, U.S. Government Affairs, and other teams to ensure aligned strategies on internal and external policy development. Efficiently manage and drive multiple projects to completion.
Qualification and Experience
The candidate should have Juris Doctor degree from nationally recognized Law School. Must have 10+ years of legal experience. Experience counseling clients on health law compliance issues is required. Must have analytical risk identification, evaluation, and management experience. Experience leading or directing the work of others is desired. Experience in fraud and abuse laws, including the Anti-Kickback Statute and its safe harbors and the Stark Law is desired. Medical device industry experience is desired. Familiarity or experience with payer, provider, and reimbursement issues is desired. Understanding of value-based healthcare is desired. Excellent written and verbal communication skills desired.
