Director and Assistant General Counsel, Data Privacy The candidate will be responsible for privacy, data protection, and cybersecurity legal issues, regulatory filings, training programs, third-party assessments, risk management strategies, vendor contracting, and legal compliance with data protection laws and regulations. Will provide legal counsel and guidance on a wide variety of data protection and privacy legal matters which arise from the operation of a large, complex, geographically dispersed and technology-driven organization. Provide legal advice and guidance on data privacy topics to the company's senior leaders, managers and other internal colleagues and clients in the US and globally (for global projects involving US) to confirm that current and proposed activities, policies, business practices and transactions comply with relevant data privacy laws and regulations. Carry out the direction and strategy for the company's Global Privacy Program, including providing guidance on applicable privacy laws and regulations, implementation of the program, including company policies and processes covering the privacy and security of personally identifiable information in accordance with global, federal, state and local laws. Work with the Global Privacy Officer, ensuring the company's compliance with the HIPAA and its implementing regulations, the European Union General Data Protection Regulation (GDPR), data protection laws and regulations outside of the EU, Federal Trade Commission guidance, and US state privacy and information security laws and regulations. Lead the company's HIPAA/state medical privacy compliance initiatives with respect to the handling of protected health information (PHI) as well as medical information not subject to HIPAA.
Qualification and Experience
The candidate should have a J.D. degree (completed and verified prior to start) from an accredited law school and member of a US Bar in good standing. Must have 7 years of experience in data privacy law in a private, public, non-profit, government, or military environment. Certification from relevant professional organizations, such as the International Association of Privacy Professionals, is required. Working experience in an AmLaw 100 firm and/or Fortune 500 environment in an attorney role is strongly preferred. Significant knowledge of and experience with HIPAA, HITECH, CCPA and other US state and federal privacy laws desired. Familiarity with health care relevant legislation and standards for the protection of health information and patient privacy is an asset. Knowledge of business processes within diverse industries, including, product development and approval, manufacturing, marketing and selling is required. Should understand public policy and healthcare industry developments, the legislative and liability implications of business decisions. Advanced understanding of global privacy trends, best practices and legal and regulatory requirements, including GDPR, is essential. The ability to form solid assumptions and formulate decisions and recommendations from diverse facts and information is a must. Extensive familiarity with health care relevant legislation and standards for the protection of health information and patient privacy is needed. Expert knowledge of HIPAA/state medical privacy laws is essential. Candidates with in-house experience creating and leading a privacy program at a healthcare technology company, healthcare system, or a related industry are strongly encouraged to apply.
