eDiscovery Senior Counsel The candidate will be responsible for; Assisting Associate General Counsel for Records and eDiscovery in developing e-discovery strategies to support both local and global functions. Providing guidance and strategic advice to in-house and outside counsel on eDiscovery strategy and eDiscovery topics from legal hold through production in litigation and other adversarial proceedings. Serving as principal liaison between global eDiscovery Center of Excellence for eDiscovery (CoE) and firmâ€™s Litigation Practice Group (LPG). Partnering and working collaboratively with the LPG and outside counsel on all aspects of e-discovery, including ESI preservation (including strategy, scoping and execution), collection, search and refinement processes Including technology assisted review (TAR) and other analytics), review, and production, meet and confer strategy and communications, and eDiscovery motion strategy and practice. Preparing eDiscovery portions of FRCP Rule 26 initial disclosures and state counterparts. Working with counterparts in [privacy] to ensure that international and local discovery practices comport with legal and business requirement and policy positions with respect to data transfer and storage, including GDPR considerations. Tracking developments in state, federal and international e-discovery law, making recommendations and providing training about best practices. Partnering with IT and providing eDiscovery requirements for new technology used for business purposes. Identifying potential legal risks associated with new technologies or business practices and raising issues with LPG and CoE as needed. Identifying and driving implementation of tools, vendors, and processes needed to support continuous improvement in eDiscovery capabilities. Providing requirements for eDiscovery solutions and serving as business lead for evaluations of tools. Serving as a point of contact on strategic eDiscovery topics for eDiscovery vendors. Monitoring metrics related to eDiscovery vendor work, including document review, to drive quality and cost-effectiveness. Monitoring metrics related to law firm work on eDiscovery issues to drive quality and cost-effectiveness. Should preferably have J.D. degree with Bar admission and 8+ yearsâ€™ experience, with substantial experience in eDiscovery in complex adversarial matters. Excellent academic credentials required. Experience in the pharmaceutical, biotechnology or related life science industry preferred. Experience with cross-border discovery preferred. Experience with meet and confer sessions preferred. Experience with in-court discovery motion practice preferred.
