Senior Counsel – Retirement Services The candidate will be responsible for providing legal advice and for analyzing implementing and maintaining appropriate compliance programs for company’s Major Accounts Division (BPO) business. Possess substantive knowledge related to employee benefits including ACA, COBRA, ERISA, FSA, and HIPAA; employment law experience a plus. Provide advice regarding compliance issues which arise in the business units, developing compliance programs as needed, coordinating performance of compliance responsibilities with business units, and providing compliance training. Position will also generally support the company’s MAS Division, which includes negotiating and drafting contracts (including vendor and strategic business partner agreements); analyzing legal issues regarding new products and services; and advising on day-to-day legal issues affecting the MAS Division. Interface with all levels of Division and Corporate Management. Responsible for ensuring that contracts negotiated and advice given reflect the company’s policies and business practices, including the legal directives of the Corporate Legal Department. Act as legal contact and compliance team escalation point for compliance issues, coordinate performance of compliance responsibilities with business units and provide necessary compliance training programs. Perform compliance analysis and provide compliance advice on MAS services, including day-to-day compliance advice on current products and services and compliance advice regarding new products, services and/or new features to current products. Advise on changes in operational models for products and services which would minimize compliance risk, as well as business risk. Experience in managing and writing compliance policies and training programs a plus. Draft and negotiate complex contracts with existing and prospective MAS Division third party business partners. Provide day-to-day legal support to all levels of Division Management. Review a variety of contracts, forms, and marketing materials. Support client contract negotiations when needed. Substantive knowledge and 5+ years of experience related to ACA and employee benefits including ERISA, FSA, COBRA, and HIPAA required. Juris Doctorate from an accredited U.S. law school and valid Bar admission required. Admission to the state Bar preferred. Employment law experience including FMLA preferred. Benefits Attorney Preferred, some Employment law knowledge a plus. Exp with BPO (Business Process Outsourcing) highly preferred. Very strong legal drafting skills with a meticulous attention to detail and form required. Excellent verbal and written communication skills required. Strong negotiation skills with good business judgment required.
