Curative Attorney Duties: To provide resolution of title defects. To review title to ensure that there are no defects or breaks in the chain, and perform curative; therefore, the company can issue an accurate commitment letter and final title policy to the lender. Position also includes working with underwriting claims resolution, clearance and title curative for multiple states. To assist title and processing employees, both Streamline and First Title, with questions, and provide resolution. Other duties as may be assigned Review and recognize escalation issues, noting the First Title website as to current status and include the following: Review the title commitment for accuracy. Review abstract and legal description. Enter modifications to the title, if necessary. Research the title to determine if “clear”. Investigate the reasons around a possible “not clear” title. Resolve title clearance issues to get loans closed. Communicate with lenders and borrowers to obtain all necessary title clearance requirements. Perform daily follow up work on all work in progress and assist with issues to ensure work is completed within established timeframe. Review title commitment for clearance and assure all items are accounted for including but not limited to updating payoffs, subordinations, homeowner’s insurance policies, taxes and HOA.
Qualification and Experience
Qualifications: Member of Virginia bar in good standing. 5+ years’ experience in reviewing title commitments and documents for validity and the ability to independently clear title issues. Experience in: correction of chain of title issues; work with underwriters regarding curative actions and title claims; correction of legal description errors; obtain releases of prior liens; deeds of trust; mineral claims; judgments and IRS liens; actions regarding outstanding taxes and tax sale issues. Ability to read and interpret documents such as Form 1003, Pre-Hud, title and ICLS documents, title commitment documents, tax certifications, real estate closing and property tax information, HUD-1 settlement statements. Ability to write reports, correspondence, and memos. Ability to effectively present information and respond to questions from groups of managers, clients, customers, and the general public. Attention to detail and communication skills must be excellent.
