Counsel-Senior The candidate will provide legal support and counseling for company’s regulatory compliance functions, especially the company’s compliance with the laws and regulations administered by the U.S. Department of Transportation (“US DOTâ€), U.S. Environmental Protection Agency (“US EPAâ€), and California Air Resources Board (“CARBâ€). Responsibilities: Ensuring the company is aware of impending changes and developments in its government compliance obligations, particularly, in the areas of emissions and fuel economy. Work closely with the company’s engineering and quality groups to ensure timely compliance with reporting and other requirements with regard to emissions, fuel economy, and other regulatory areas administered by the US DOT, US EPA, and CARB (as well as other state agencies, as applicable). Provide advice in these areas and to interact directly with federal and state regulators as appropriate, as well as to support company’s government relations team on federal and state policy issues related to emissions and fuel economy. Represent company on relevant working groups of Global Automakers or other trade associations, as needs dictate. Provide day to day legal support and counseling to internal clients regarding government and regulatory compliance, especially with regard to US DOT , US EPA, and CARB. Ensure that internal clients are aware of impending changes in regulations and laws that affect the company’s business operations and reporting obligations. Counsel business units on litigation and government reporting risks, as necessary. Represent company on trade association working groups. Manage the defense of lawsuits and other litigation matters as needed, with the potential to get involved in other matters affecting the company’s business operations. Manage the defense of regulatory investigations and litigation, including class actions, relating to emissions, fuel economy, and related matters. Work with paralegals, engineers, and other internal business units. Work with outside counsel and leading teams of attorneys to develop case strategy. Interface with and maintain excellent relationships with government agencies and outside counsel. Handle other matters as team needs dictate.
Qualification and Experience
The candidate should have J.D. from an ABA accredited law school. Must have 7-10 years litigation experience, including significant leadership roles in regulatory matters and/or litigated cases, in particular class actions and/or product liability cases. Should have 10 years major law firm and/or similar in-house experience defending environmental and/or product related matters and/or working with government agencies. Familiarity with emissions and fuel economy laws and regulations and other motor vehicle laws and regulations, both at federal and state levels, is preferable. California State Bar admittance or eligible for admission to the California State Bar is needed. Should have excellent communication and negotiation skills. Must have experience managing multi-party disputes.
