Counsel cw provide guidance and support regarding the legal aspects of the employment relationship with our associates and the compliance with the myriad federal, state, and local laws that govern this relationship and the workplace including those concerning discrimination, wage and hour, immigration and “whistleblowing” Will assist US OpCos in HR-related investigations/audits including overseeing third party investigators, supporting internal OpCo investigators and sometimes personally conducting such investigations. Help educate (through training and other means) our Human Resources community about the requirements imposed by applicable Executive Orders and OFCCP regulations, including affirmative action plan requirements and will also provide support and guidance in connection with OFCCP audits as applicable . Represent our operating companies before various federal and state government agencies and manage charges filed by associates with such agencies (e.g. EEOC, DOL, NLRB, etc.), including preparation of position statements, responding to information requests, managing the administrative investigation process and playing a key role in any mediation or litigation of such charges. Assist in the management of certain employment litigation including the development and execution of effective litigation management and settlement strategies; manage the discovery process; and ensure proactive legal advice is effectively and efficiently delivered in order to mitigate present and potential future risk and exposure. Work effectively with outside counsel and report effectively on matters to the VP and Chief Counsel, L&E. Prepare training and educational materials and conduct training for the U.S. HR community with regard to various employment and labor best practices. Prepare various employment-related agreements, such as separation, contractor, and fixed term agreements. Review, revise and prepare HR operating company policies and handbooks. Work closely with the VP and Chief Counsel - L&E as well as US OpCo Legal, HR and business leaders in providing legal advice and guidance on wide-ranging employment and labor issues. Develop and proliferate best practices that meet labor and employment regulatory requirements and that deliver efficient and broad impact. Provide regular, clear communication of US employment and labor issues and opportunities to VP and Chief Counsel – L&E. Obtain positive results in disputes with employees and as a collaborative team member of the firm L&E Legal Team. Perform as a business partner to operating entities. Keep abreast of US employment/labor law developments in the statutory and regulatory arena and communicating pertinent and value-added information to the HR community to ensure compliance and minimize risk. JD degree from an accredited law school, preferably one recognized for graduating top lawyer is needed. Must be an experienced L&E attorney who has worked in both a major law firm and in-house in positions of responsibility for a variety of substantive L&E areas for the U.S. Should have 8-10 years of Land practice preferred with substantial responsibility in leading a variety of L&E issues to conclusion including employee disputes, dispute resolution (litigation, ADR), labor negotiations, and internal investigations. Expert substantive knowledge of major US employment and labor laws and regulations is needed. Significant experience in HR-related investigations and management of investigations and project management is advantageous.
