Operations Manager-Legal The candidate will monitor and supervise collection of all Bankruptcy judgment/lien, reaffirmations, pending bankruptcy, research, objections and accounts being paid outside of the bankruptcy plan. Review requests from team members to settle accounts; approve if within authority level; refer to next supervisory level if appropriate or reject the settlement proposal. Monitor call performance of team members against standards; receive input from Quality Control and Training Department; coach/mentor team members using data received from variety of sources. Maintain performance records/reports of team. Review reports to ascertain status of collections and balances outstanding and to evaluate effectiveness of current collection policies and procedures. Ensure that team members verify and update account information, properly code accounts and prepare documents. Manage production flow of legal processes to ensure timely filing and critical deadlines are met. Prepare department reports and statistical data on a monthly basis or as required. Participate in all required training for Fair Debt Collection Practices Act/Fair Credit Reporting Act (FDCPA/FCRA); other legal aspects of collections procedures. Identify violations of FDCPA/FCRA or other company policies and practices to keep supervisor advised of potential acts that may result in litigation against the company. Communicate with in-house and local counsel on various legal matters. Generate responses to legal matters as necessary or directed. Escalate legal matters as necessary to appropriate parties. Issue written and oral instructions including internal policies and procedures for the department. Assign duties and examine work for accuracy and conformance to policies and procedures. Review, update and maintain department procedures under the direction of the Assistant Vice President of Bankruptcy Operations. Conduct capacity planning, determine work procedures, prepare work and vacation schedules, and expedite workflow for subordinates. Determine staffing requirements and discuss with Assistant Vice President of Bankruptcy Operations; communicate with recruiters to identify and fill permanent and temporary assignments under the guidance of the Assistant Vice President of Bankruptcy Operations. Interview and select candidates for positions in department. Communicate assignment changes. Conduct performance counseling and coaching on a periodic basis with team members; conduct performance reviews; make recommendations for salary changes. Establish and maintain an environment that encourages team work and individual efforts and ethical behavior. Exhibit effective verbal and written communication skills to ensure flow of information up and down the chain of authority. Maintain a professional demeanor with employees, visitors, guests and vendors. Work closely with Assistant Vice President of Bankruptcy Operations to keep abreast of all management and workload issues. Responsible for ensuring compliance with applicable laws, regulations and company policies across areas of organizational responsibility. Paralegal Degree or equivalent required. 1 – 2 years of related litigation experience in a law firm or municipal or state court with at least 1 year of supervisory experience required. Preferred experience in a collection environment required.
