VP and Associate General Counsel-Litigation Responsibilities : The candidate will be ensuring that the company’s business and legal interests are protected in litigation and adversarial proceedings. Will be conducting pre-litigation assessment of potential claims for and against the Company and advising the business regarding risk mitigation strategies. Managing litigation involving the Company, including complex litigation (commercial, employment, etc.) and regulatory enforcement proceedings, including oversight of outside counsel’s handling of litigation and adversary proceedings. Applying a focus on cost efficient handling and resolution of disputes, including developing and ensuring adherence to appropriate budgets for litigation matters and other disputes. Developing and implementing appropriate internal policies, processes and procedures regarding litigation matters, including discovery. Acts as a primary counsel for the company on litigation matters and adversarial proceedings. Manages multiple concurrent litigations and adversarial proceedings for all divisions of the company, across a broad range of subject matters and jurisdictions. Manages outside counsel handling litigations and other matters, including providing strategic and tactical direction, and management of and adherence to budgets. Performs pre-litigation assessments and early case evaluations for each matter, prepares and updates case summaries, and develops strategies to successfully resolve each matter. Evaluates potential conflicts with third parties, and proactively assesses opportunities and applies strategies to diffuse issues from maturing into problems or litigation, and more broadly, develops risk mitigation strategies for the business. Coordinates and prepares responses to discovery, identifies key witnesses and manages the discovery process from the company’s side; and communicates to management regarding case and settlement strategies.
Qualification and Experience
Requirements : The candidate should have a Juris Doctorate from a top tier law school. Minimum of 8-10 years of intensive prior litigation experience, preferably with experience both at a top tier law firm and as in-house counsel, and preferably with trial experience. Experience across multiple areas of litigation and adversary proceedings (commercial, employment, regulatory, class action, intellectual property, internal investigations, etc.). Exceptional analytical and problem-solving skills. Exceptional verbal and written communication skills. Strong negotiation skills ‐ Flexible and creative thinker. High integrity and individual courage ‐ Strong leadership skills. Highly organized with solid project management skills. This position requires an exceptionally accomplished attorney with a distinguished professional record and a strong business orientation. Personal and professional ‘fit’ within company’s culture is of paramount importance. Candidates must be self-motivated and exhibit a passion for understanding company’s business and contributing in a meaningful way to its strategy and long term strategic goals. Able to approach this role from an experienced business perspective and demonstrate a high degree of ethics and integrity, as well as strategic/conceptual thinking capabilities.
