ProfileTrial Attorney - Remote The candidate will have to represent insureds and the Company in the defense of bodily injury and property damage lawsuits, subrogation, and Financial cases. Prepare for and conducts hearings, trials, arbitrations, mediations, and depositions. Prepare and argue pre and post-trial motions. Assist colleagues in the resolution of calendar conflicts. Provide counsel to business clients on day to day issues. Will monitor and review new laws, regulations, and case law; identify and summarize relevant issues; collaborate with other areas of L&R department; proactively provide advice and counsel to business unit on the impact of new laws on business; monitor counsel. Will have to bring subject matter expertise in claims defense litigation to represent clients who are customers of the firm in bodily injury (BI), property damage, no-fault/PIP, special investigations (SIU), arbitration and subrogation cases. Will acquire broad knowledge of the firm and business lines as well as assert processes, procedures and best practices. Will manage a caseload from end to end by acquiring, compiling and integrating case-related information and legal research, developing and implementing litigation strategies in cooperation with your clients and claims personnel. Will determine litigation tactics and negotiate cases for timely claims resolution. Will be assessing liability and damages, and develop defenses to allegations for successful resolution of cases; attending hearings, mediations, and conduct trials. Argue motions, take effective depositions of lay and expert witnesses. Consult with clients and opposing counsel and the judiciary. Coordinate the case handling with claims personnel and complete necessary system documentation. Assist other attorneys in resolving calendar conflicts. Will be expected to handle a full pending of cases comparable to the file load of an office based attorney. Will be affiliated with an Staff Counsel office but will not have a physical office in the staff counsel location. Equipment will be set up at home. Will have regular work schedules agreed upon and must be accessible during those hours. Will have to be available during regular office hours to participate in meetings, cover court appearances or travel to the Staff Counsel Office as required. May be required to attend on-site events in an office that are necessary for the completion of their job responsibilities, including, training, meetings, conferences, performance management conversations, etc.
Qualification and Experience
The candidate must have a Juris Doctorate Degree and MUST be a member of the State Bar of Tennessee. An experience of 2- 5 years in litigation is required. Experience in personal injury, auto negligence, insurance defense will be preferred. Basic computer skills along with experience with Microsoft Office, Outlook, Computer Calendars, Westlaw, Lexis, and the internet is needed. Must have an ability to work well with others on a team of attorneys, paralegals, administrative assistants, supervised by an attorney Lead Counsel.
