ProfileCounsel The candidate reports to the SVP, Chief Compliance and Legal Officer, and Corporate Secretary. Provides legal coverage advice to Claims department of company and its subsidiaries. Provides legal advice and legal review to the company's Claims department. Be primarily focused on supporting Claims by providing review and advice on pending and potential claims, especially those that could potentially result in extra-contractual liability to the company. Manages extra-contractual, corporate, and general commercial litigation against the company. Management to include substantive input into content of pleadings and motions, as well as providing status reports and strategy recommendations to management, and may include input on declaratory judgment actions. Contributes to Group's success by avoiding or minimizing judgments against the company, by defending Group in litigation, or acting as liaison between outside counsel and the company. Oversees portion of Compliance and Legal's departmental budget for outside counsel, maintain Compliance and Legal's Litigation Billing Guidelines, and develop National Panel Counsel programs. Serves as a secondary resource to our national Claims team on coverage reviews. Regularly reviews and revises reservations of rights and denials for Claims, including assisting in the development of templates. Advises Claims on state-specific issues, including recommendations for filing declaratory judgment actions and appointing independent counsel. Contributes to Claims round-table discussions by advising on coverage and claims handling issues. Also coordinates with Senior Counsel responsible for Underwriting and Product Development management to advise as to emerging issues. Contributes to Group's success by representing the company in Government and Regulatory Affairs. Identifies topics, creates content, and provides at least quarterly training to Claims and other internal client groups, as appropriate. In connection with the foregoing responsibilities, studies and interprets laws, court decisions, regulations, and other legal authorities to advise Group on legal matters and to mitigate the company's exposure. Prepares quarterly and annual reports, including related Enterprise Risk Management reporting regarding Claims and Corporate litigation. Should have a J.D. degree, with license to practice law in one or more US jurisdictions, and, if not licensed in the state in which the position is filled (California, Texas, or Pennsylvania), registered as in-house counsel with the State Bar. Must have 5-7 years of comparable experience in property and casualty insurance law, preferably with at least some of that experience in an in-house counsel position.
