Chief Compliance Officer- Dental Platform The candidate will be responsible for leading the Compliance Program for the Dental platform. Collaborate with legal, compliance and business colleagues to develop, implement, and maintain the Compliance Program for the platform, to include implementing written policies, procedures, and standards of conduct, leading effective training programs, conducting internal monitoring and auditing, and directing investigations to respond promptly to detected offenses and undertake corrective actions. Because there is significant complexity in the dental platform, driven by diversity of technologies and services, customers, and channels, a matrixed organization, it will be imperative that the successful candidate possess a strong intellect, agility and sound judgement. The position must demonstrate strong knowledge of healthcare fraud and abuse laws and have experience in the healthcare industry, preferably with a drug or medical device manufacturer. Lead the Compliance Program for the Dental platform. Demonstrate a solid understanding of the dental platform businesses, their goals, and compliance risks and identify appropriate compliance strategies to facilitate those goals and minimize those challenges. Responsible for the platform’s Compliance Program planning and development functions, ensuring there is a plan designed to meet all Compliance Program requirements, in line with appropriate regulatory requirements. Promote (a) use of the Compliance Hotline, (b) heightened awareness of Standards of Conduct, and (c) understanding of new and existing compliance issues and related policies and procedures. Monitor and report results of the compliance/ethics efforts of the platform and provide guidance for senior leadership on matters relating to compliance. Monitor the performance of the Compliance Program and related activities on a continuing basis, taking appropriate steps to improve effectiveness. Effectively managing, developing and coordinating the dental platform compliance paralegal and global dental platform compliance resources. Act as a strategic business partner for senior leadership on matters of major importance to the company and provide information related to all aspects of the platform’s compliance, including reporting ongoing compliance issues and intentional acts of non-compliance, fraud, waste and abuse. Identify potential areas of compliance vulnerability and risk; develop and implement corrective action plans for resolution of problematic issues, and provide general guidance on how to avoid or deal with similar situations in the future. Collaborate closely with colleagues on the Dental Legal Team, Internal Audit, HR, Finance and other core functions in order to direct compliance issues through the appropriate channels for investigation and resolution as well as work towards future improvements as the Compliance Program evolves. Provide an independent review and evaluation body to ensure that compliance issues/concerns within the platform are appropriately evaluated, investigated, and resolved. Partner with the appropriate business areas to deliver supplemental compliance training that further amplifies the corporate program, engages employees, and addresses specific needs within the Dental platform. Assist with mergers & acquisitions from compliance due diligence to post acquisition compliance integration. Advise on day-to-day general compliance questions and questions under local civil, commercial, corporate, conflicts of interest, data protection and privacy laws. Provide advice on new business models such as social media initiatives and new forms of interactions with patients, healthcare professionals, payors and other customers. Identify and executing on opportunities for continuous improvement, efficiency and savings in providing compliance services. Willing to work on the smallest and simplest, as well as the most complex, compliance matters faced by the platform.
Qualification and Experience
Bachelor of Science or Bachelor of Arts degree required. JD or MBA preferred. 7+ years of compliance experience and experience of managing people is preferred. Experience in the healthcare industry, preferably with a drug or medical device manufacturer required. Compliance certifications/credentials preferred. Experience in the healthcare industry, preferably with a drug or medical device manufacturer and understanding requirements relating to interactions with health care professionals required. Knowledge of healthcare fraud and abuse laws and background in the healthcare industry required. Preferred experience in the Dental industry. In-depth knowledge: of applicable global regulatory and compliance requirements, with an understanding of how these requirements apply to the organization’s daily operations; and understanding of compliance risk management practices and methodologies, including risk assessment, monitoring/surveillance, and testing activities required. Strong: project management skills, to include managing and prioritizing multiple concurrent projects, mapping budget and resource curves, and reporting progress and risks to colleagues and senior management; business and financial acumen, with demonstrated understanding of core business processes required. Experience: in conducting investigations and managing the entire investigations process, including the management and tracking of the investigation lifecycle and the close-out process; in executing on action plans to remediate issues identified in investigations; in developing and maintaining effective lines of communication, including the management of a Compliance Hotline; in the development, initiation, maintenance, and revision of policies and procedures for the general operation of a Compliance Program and its related activities to prevent illegal, unethical, or improper conduct; in monitoring the performance of a Compliance Program and related activities on a continuing basis and taking appropriate steps to improve effectiveness required. Trade compliance experience preferred. Strong written and verbal communications skills, ability to act as a change agent through dynamic interactions with others required.
