ProfileLegal Counsel, Global New Business Models and Healthcare The candidate will advise commercial attorneys and business partners in each of firm's Groups, Regions and Functions, and manage risk presented by applicable regulatory regimes, including the U.S. Anti-Kickback Statute and its safe harbors, the Physician Payments Sunshine Act, the Federal False Claims Act, Stark Law, and other laws and regulations pertaining to physicians, hospitals, clinics, and the delivery of healthcare around the globe. Will provide legal advice to the Medtronic Office of Ethics and Compliance and Group and Regional compliance teams. Identify, anticipate, counsel on and help mitigate key legal risks. Serve as a subject matter expert on fraud and abuse and healthcare compliance issues to build consensus and develop policy. Develop expertise on emerging and cutting edge legal issues facing the company. Provide day-to-day advice, counsel and training of commercial attorneys, business clients, and other functional representatives. Facilitate discussion and drive consensus regarding resolution of legal and business issues. Efficiently manage and drive multiple projects to completion.
Qualification and Experience
The candidate should have Juris Doctor degree and 7+ years of legal or compliance experience. Experience counseling clients on health law compliance issues is essential. Should have experience in fraud and abuse laws, including the Anti-Kickback Statute and its safe harbors and the Stark Law and analytical risk identification, evaluation, and management experience. Medical device industry experience is desirable. Familiarity or experience with payer, provider, and reimbursement issues is desirable.Understanding of value-based healthcare is desirable. Excellent written and verbal communication skills is desirable. Should have strong legal skills and judgment and the ability to assess and advise on complex risks while interacting effectively with a variety of individuals across the organization.
