ProfileAttorney Loan Processing Operations The candidate will provide legal representation to the association for the protection of material interests on long and short-term loans, including those requiring compliance with consumer laws and regulations, by managing the title review and securitization process on loans closed by the Association. Will oversees and provides legal counsel and legal advice and recommends and approves solutions and courses of action to affect the timely closing of loans. Reviews new regulations laws related to the loan closing process to gauge the applicability to the association and advises senior management as to operative changes necessary to achieve compliance. Oversees design and content of legal forms and revisions to existing forms in response to changes in laws, regulations and policies, monitoring of applicable federal and state statutes, regulations and court decisions as they relate to the loan closing and securitization processes of the association. Reviews and evaluates title examination work of outside attorneys and the performance of association title and legal requirements and implements necessary corrective measures. Assist in preparation and completion of documents for acquired property sales and loan transactions as required. Confers with Loan Committee as needed. Confers with loan officers regarding legal issues surrounding loans.
Qualification and Experience
The candidate should have JD Degree from an accredited law school with a license to practice law in the State of Texas. Should have 8+ years of experience practicing law that includes significant work in real estate transactions and mortgage lending, with an emphasis on consumer lending and compliance with the Dodd-Frank Act and the related regulations. Specialized knowledge in areas of law pertaining to consumer lending, real estate and mortgage lending, including debtor/creditor relationship, truth-in-lending, RESPA, ECOA, consumer financial protection, security interests, and bankruptcy. Specialized knowledge of the Farm Credit Act and regulations. Ability to conduct legal research using electronic manual sources. Intermediate skill level in Microsoft Office applications.
