Employment Attorney The candidate will report to the Vice-President, Associate General Counsel. Will partner directly with the Human Resources team and business functions to provide employment-related legal advice and services for the company. Provide day-to-day proactive employment law advice, assistance and counsel to HR and management on a variety of subjects, including hiring practices and procedures, employee performance management and separations, FMLA and other protected leaves, ADA reasonable accommodation, and wage/hour issues. Manage US, Puerto Rican and Canadian employment litigation, working with outside counsel. Investigate and defend state and federal charges of discrimination, wage/hour audits and other regulatory complaints, including preparation of position statements and other responsive documents. Draft employment, settlement and separation agreements. Assist in employment-related aspects of mergers/acquisitions, as well as reductions in force and location closings (e.g., severance, WARN Act). Ensure compliance with labor and employment laws and regulations, including the development, implementation, interpretation, and maintenance of employment-related HR and operational policies and assistance in development and presentation of education and training materials. With assistance from outside counsel, oversee labor relations items such as the negotiation of collective bargaining agreements, handling of union grievances and implementation of union avoidance best practices. Serve as a key member of the employment law team, leading projects to identify and manage employment-related legal risks. Provide sound legal advice and effectively integrate business and legal issues in such advice. Should have a J.D. degree from an accredited law school. Must have 5-8 years of relevant employment and/or labor counsel experience. Prior in-house counsel experience is a plus. Some overnight travel is required.
