Labor and Employment Associate The candidate will be responsible for employment litigation defending employers in single-plaintiff claims, class and collective actions and suits to enforce and oppose enforcement of restrictive covenants, including drafting responses to written discovery, managing e-discovery, briefing dispositive motions, examining witnesses at trial or in arbitration and conducting mediations and settlement conferences. Will have regular responsibility for investigating and drafting responses to administrative charges at the EEOC and similar state and local agencies, including witness interviews, position statements and appearances at fact finding conferences and mediations. Deal with client counseling of in-house attorneys, human resources professionals and managers on wide array of labor and employment issues, including individual terminations, leave of absence issues, employee discipline, reductions in force (including adverse impact analyses and OWBPA disclosures), compliance with federal, state and local employment laws and regulations (including ADA, ADEA, FMLA, FLSA, Title VII, WARN and whistleblower and anti-retaliation laws), classification of workers as employees or independent contractors, mergers and acquisitions and internal investigations. Draft employment agreements, restrictive covenant agreements, employment policies and separation and release agreements. Should be a TX licensed junior or mid-level associate with 1-2 years of experience. Should have strong academic credentials from a nationally recognized law school and have mid or large law firm experience in labor and employment litigation and counseling.
