ProfileAssociate General Counsel The candidate will be filled as Senior Counsel OR Associate General Counsel, dependent on experience level and has collaborative responsibility for legal matters including healthcare regulatory legal and compliance advice, corporate business issues, complex transactions, mergers and acquisitions, process improvement, and policy drafting and implementation. The Senior Counsel / Associate General Counsel works with the General Counsel and Chief Compliance Officer to provide exemplary legal services to our executive team, shared services and operations nationwide. Assist General Counsel and Chief Compliance Officer in strategic development, implementation, and evolution of compliance program including conducting risk assessments, proactively advising on compliance-related issues, handling compliance investigations and management of training programs that build and promote employee understanding of and engagement with compliance concepts. Develop, initiate, and revise policies and procedures for the general operation of the compliance program and its related activities to prevent illegal, unethical or improper conduct. Counsel on legal and regulatory matters impacting the healthcare industry including fraud and abuse, anti-kickback laws and regulations, and Medicare and Medicaid coding and billing. Oversee and perform compliance due diligence on potential acquisition targets. Advise on transactions and contract drafting and negotiation. Provide advice and counsel to business on a wide variety of corporate and commercial issues arising in day-to-day operations of a complex organization in a heavily-regulated environment. Conduct internal investigations as needed. Collaborate with other departments (for example, human resources, IT, EHS, and operations) to direct compliance issues to appropriate existing channels for investigation and resolution. When necessary, at the direction of the General Counsel and Chief Compliance Officer, communicates with government regulatory bodies to address issues of significance. Develop a thorough understanding of and familiarity with the organization’s business, its people, markets, facilities, customers and competitors in order to identify trends and formulate appropriate legal advice, structures and strategies. Establish and maintain a rapport and working relationship with business managers in order to encourage and continue the proactive use of in-house legal counsel. Perform special assignments as needed. Support and develop collaborative working relationships within the department.
Qualification and Experience
The candidate should have Bachelor's degree (B.A.); Juris Doctor (J.D.). Must be admitted to the Bar in at least one state, and currently in good standing. Should have familiarity with health care laws, regulations and standards. Must have understanding of coding and reimbursement systems. 4 years experience with health care legal/compliance issues, preferably in-house or at a reputable law firm is needed. Experience with risk management is needed. Should have experience conducting and overseeing internal investigations and communicating with regulatory bodies. Must have superior collaboration, communication and diplomacy skills; ability to influence others. Proficiency in Microsoft Office applications, including Word, Excel, PowerPoint and Outlook is needed. Background in any of the following areas would be a plus: litigation; employment law; mergers and acquisitions; anti-trust.
