Director, Legal & Compliance The candidate will directly oversee and manage the Company’s Compliance Program in North America and China, Asia Pac, Latin America (CHAPLA). Also assist the Senior VP Law in managing the Company’s compliance program in other regions around the world. Responsible for the compliance program design and enhancement, including strategy training, monitoring, auditing, identifying, solving and/or escalating legal compliance risks, and enforcement. Drive and ensure a culture of ethics and compliance in assigned regions and lead efforts through cross-functional teams. Advise all levels of employees and management with respect to ethics and compliance issues. Ensure contract and process compliance with healthcare related compliance statutes and codes of conduct, including anti-kickback and false claims, and supporting international compliance efforts in line with the FCPA and anti-bribery enforcement. Draft and/or negotiate complex HCP agreements with HCP to ensure ethics and compliance. Oversee the third party due diligence program, including clearing red flags. Oversee transparency reports in jurisdictions within regions of responsibilities. Monitor compliance updates within the scope of responsibilities, benchmarking within industry and proposing options on compliance with the same to the General Counsel and other internal clients as appropriate. Recent examples of such updates include ISO 370001 and DOJ’s Evaluation of Corporate Compliance Programs. Special projects as assigned. J.D. from an accredited law school; member of California state bar preferred. Compliance certificate preferred. 6 – 10 years of progressive responsibilities and/or compliance leadership preferred. Legal experience in a relevant law firm or corporate setting; medical device, pharmaceutical or other healthcare-related experience in a compliance role preferred. Expert knowledge of Industry Code requirements required. Substantial decision-making ability, with a focus on helping the company achieve its strategic business objectives while managing the legal risks involved required. Excellent documentation and communication and interpersonal relationship skills including negotiating and relationship management with ability to drive achievement of objectives required.
