Consumer Compliance Counsel Duties: Reporting to General Counsel and Chief Compliance Officer, will work on consumer credit and consumer finance issues to ensure that the employees, management and the Board of Directors are in compliance with the rules and regulations of regulatory agencies, that the company policies and procedures are being followed, and that behavior in the organization meets the company’s Standards of Conduct. Will become a critical member of a team of attorneys responsible for counseling the company’s various business units and executives on compliance with privacy and data protection matters. Provide legal assistance to the General Counsel in managing the day-to-day operations of the company’s Compliance Program including business operations that may be impacted or driven by licensing and regulatory requirements. Advise the business regarding compliance with applicable consumer protection, consumer finance, and consumer credit law when developing and launching new products and programs. Monitor, and as necessary, coordinate compliance activities of other departments to remain abreast of the status of all compliance activities and to identify trends, especially in the area of consumer and financial regulations. Respond to and manage alleged violations of rules, regulations, policies, and procedures. Identify potential areas of compliance vulnerability and risk; develop/implement corrective action plans for resolution of problematic issues, and provide general guidance on how to avoid or deal with similar situations in the future. Investigate and, as necessary, provide advice on the resolution of potential compliance issues. Support the development and delivery of compliance training programs. Liaise with outside counsel and respond to information requests as necessary. Ensure internal and external client deliverables are timely and accurate. Interact comfortably with various departments and employees, ensuring that their legal needs are met and their questions answered. Assist in preparation of legal presentations.
Qualification and Experience
Qualifications: A Bachelor’s degree from an accredited college and a JD Degree from an accredited law school required. 3-7 years of work experience in the financial services sector is a must. Several year of experience as an Associate, Counsel, and/or Partner at a law firm and/or government agency. 1-2 years of experience as in-house counsel is a plus. Substantial experience in several of the following federal laws and corresponding state laws is expected: Truth in Lending Act (TILA), Fair Credit Reporting Act (FCRA), Unfair, Deceptive and Abusive Practices Act (UDAAP), Gramm-Leach Bliley Act (GLBA), Consumer Leasing Act, Magnuson-Moss Warranty Act, Equal Credit Opportunity Act (ECOA), Federal and state advertising laws. Industry experience in solar is preferred. A background in consumer finance lending licensing management and/or compliance, as well as direct experience with state licensing authorities. Familiar with regulatory topics, practices and procedures as they relate to the lending industry including origination, loan servicing, loss mitigation and foreclosure/default. Excellent project management, time management and implementation skills. Detail-oriented, resourceful and able to manage shifting priorities. Excellent written and verbal communication skills required. Ability to positively and effectively interact with internal and external customers. Comfortable rolling up his/her sleeves and being hands-on.
