The Illinois Supreme Court has taken a forward-thinking stance on the integration of artificial intelligence (AI) into the judicial system. A new policy, set to take effect on January 1, allows judges, attorneys, and court officials to use AI tools, provided they adhere to ethical and legal standards.
Encouraging Innovation While Ensuring Accountability
The court’s policy emphasizes that AI use should be permitted and expected, as long as it upholds the principles of justice and fairness. This move aims to enhance efficiency and streamline processes within the judiciary while maintaining accountability for all AI-assisted work.
"This policy reflects our recognition of AI’s growing presence in the legal field," said Chief Justice Mary Jane Theis. "Our framework ensures that these tools serve the cause of justice without compromising its integrity."
Ethical Standards and Oversight
Under the policy, key safeguards have been established to guide AI usage:
Responsibility for AI Outputs: Judges and lawyers are required to review any AI-generated content to ensure accuracy and reliability thoroughly.
Data Protection: AI tools must be used in a manner that protects sensitive information.
Preservation of Justice Principles: The judiciary will actively monitor for AI applications that might undermine due process or equal protection.
Attorneys who misuse AI—such as submitting filings based on inaccurate or fabricated information—risk facing sanctions. Unlike some other jurisdictions, Illinois does not mandate the disclosure of AI use in legal filings, instead relying on professional standards to ensure proper application.
The National Landscape
Illinois joins a growing number of courts nationwide that are adapting to the rapid rise of AI in legal practice. In October, Delaware’s Supreme Court issued a similar policy addressing AI usage by court officials. Other jurisdictions have created committees and task forces to explore the implications of AI on judicial processes.
The use of AI is already reshaping the legal landscape, offering tools that promise faster research, more efficient case management, and improved access to justice. However, it also introduces risks related to bias, inaccuracy, and the potential erosion of public trust in the legal system.
