Interviewing skills are part of your everyday life and work as a lawyer. When they talk about a lawyer "counseling" a client, what do they mean? What else if not an "interview", where the lawyer (interviewer) is trying either to persuade the client (candidate) that he should take or refrain from taking certain action because of the legal consequences involved, or to elicit information from that client that will help the lawyer find the legally correct solution? Perhaps this is why the clinical legal studies course in client handling, which is offered at just about every law school in the United States, is invariably called "Interviewing and Counseling."
 
The Good Lawyer-Interviewer Hones Skills

Interviewing skills are not put on the shelf once one has received a job offer or otherwise passed beyond the stage of interviewing for a job. When dealing with a client or with his colleagues in everyday business situations, the lawyer is selling himself just as much as during a legal job interview, only more subtly so. The same techniques that are necessary to impress a lawyer-interviewer favorably are the same techniques necessary to win over a client or colleague who for various motives may have just as much reason to try to "screen you out" as a lawyer interviewer who must pick a winner out of a hatful of qualified candidates.


The good interviewer never stops interviewing; he hones and polishes his skills to a fine gloss, makes mental notes or written files of recurring interview situations, and forever seeks to come across in the light most favorable to himself, while focusing all of his concentration and energy on making the "other guy" open up, do all the talking, and maybe make a mistake or two.

There is a saying in Zen Buddhism that "you cannot pour water into a cup that is already full." What is meant is that you cannot learn anything, by reading something written by someone else or listening to what someone else has to say, when you are yourself talking or are focused on the ideas and thoughts randomly whirring through your head at the speed of light (the Zen Buddhists also say "the mind is like a drunken monkey"). One of the first lessons in any speed reading course is to stop verbalizing in your mind the words that you read on the printed page--to let your eyes scan the words quickly without anything happening between your ears. Amazingly, you retain the information better this way than by reading each word and sounding it out in your head.

To truly absorb information from the outside world you must quiet yourself internally, literally "turn yourself off' like a light bulb, so that you can catch not only the words and pictures coming in from without, but also feel the rhythm and the music - the tone of voice and body language of the person speaking, the context in which he places information - that in the end may tell you more about the other person and what he is trying to tell you than the words themselves.

The process of turning yourself off and focusing the interview on the other person lies at the heart of successful legal job interviewing. It lies at the heart of the lawyer's life and work as well.
