Predicting Labor Law's Growth Areas

Labor attorneys expect their practice specialty to enter the next decade in a position of strength. It appears that this specialty will present considerable practice opportunities in the next five to ten years.

Geographic labor practice growth mirrors the economies of different regions of the country. For example, as industry moved to the Sun Belt—which extends from the Carolinas to Southern California— during the 1970's, labor law practice also grew. Generally, areas considered strong economically are also typically considered strong labor growth areas.


Geographic and practice areas of growth are somewhat interdependent. If more women (who are entering the work force in record numbers) and high technology workers are organized, the Northeast and Silicon Valley in California will experience a rapid expansion of labor law practice. If the number of states instituting public employee collective bargaining statutes increase, so will related labor practice.

Just as state statutes lead to expansion of labor work, so do federal government regulations. Labor attorneys must interpret and adjust the policies of clients as government decisions effect policy changes, so as to conform to the new statutes.

Growth is also likely in the area of age discrimination. It has been demonstrated that the baby boom portion of the population has had an effect on issues through every period of their lives. As they become older, issues related to their age will become crucial. It is likely, therefore, that future Equal Employment Opportunity Commission cases will reflect an increase in issues related to age discrimination.

There are also changes expected in the work performed by in-house corporate counsel. Most labor attorneys expect corporations to handle substantially more work in-house. Corporations which now hire private law firms to handle all labor litigation and negotiations will expand their legal in-house staffs by hiring experienced attorneys who will do the same work but at a much reduced rate (fixed salary versus billable hours paid to an outside firm).
