Patent Prosecution Paralegal Jobs Paralegals assist lawyers with their busy workload. They perform almost all the tasks performed by the attorneys however, they are exempted by law from advising clients on legal issues; representing clients in the court, and even settling or establishing fees. A Patent Prosecution Paralegal will provide support to attorneys in all phases of U.S. patent prosecution, including discovery, trial and appeal. Drafting correspondence and litigation documents, and preparing status reports also forms an important part of a paralegals duty. Patent Prosecution Paralegals conduct electronic searches and provide references and order file histories. They must be prepared to handle all the duties/projects as assigned by the attorneys. Familiarity with all phases of patent prosecution activities such as drafting documents, filing at the USPTO, disclosure statements, search prior art, office actions, PCT and EFS is required of them. Biotechnology, chemistry or electrical patents background is an asset. Candidates with both U.S. and foreign patent prosecution experience are usually preferred by employers. An Associates degree in paralegal studies or a Bachelors degree with a certificate in paralegal studies is required for paralegal prosecution jobs. Paralegals generally take courses in critical thinking, communications, and legal writing.
