Patent agents are unable to offer their services of legal nature, which can be offered by an attorney and neither can an agent represent clients before the Trademark Office part of the USPTO. Patent Attorneys also have the membership of the state bar, which entitles them to provide legal services including advising on licensing of the invention matters; to appeal a decision by the Patent Office to a court; to sue for infringement; whether someone is infringing upon the claims of a clients issued patent; and conversely, whether a client is infringing the claims of someone elses issued patent. A technical degree like engineering, chemistry or Physics is generally required to become a patent agent. Examination for Registration to Practice in Patent Cases before the United States Patent and Trademark Office has to be taken in order to practice as a patent agent. Large manufacturing organizations usually hire patent agents to avail their services. Familiarity with the requirements of patent laws in the relevant jurisdictions and knowledge of patent laws in other jurisdictions are key requirements to succeed in this field. Engineers, scientists and any other science based majors, as well as law students and law graduates not admitted to a bar, can work as patent agents.
