Managing Attorney Servicing
Responsibilities: Will provide legal advice to the non-default servicing lines of business for its mortgage company, secured consumer lending functions. Primary support will relate to the servicing of closed-end mortgage loans. Effectively manage team of attorneys to provide legal advice and support for servicing requirements relating to closed-end mortgage loans. Interpret and advise regarding all federal laws that impact non-default servicing, including RESPA, Regulation X, TILA, Regulation Z, FCRA, Regulation B, UDAP, UDAAP, Regulation E, FACTA, SCRA, Garn-St. Germain, National Flood Insurance Act, Regulation AB and the Dodd-Frank Act (current and relevant proposed requirements). Advise regarding state requirements of servicing fees, full and partial lien releases, estates and trusts, annual notices, monthly billing statements, escrow maintenance, payment application, GAP insurance coverage, state SCRA, UCC and UCCC. Monitor developments in state laws and regulations, assess impacts, identify company advocacy positions and issue timely summaries of new laws or regulations that impact non-default servicing. Assist lines of business with GSE and other investor requirements as requested. Support the department that manages responses to high-level consumer complaints. Respond to legal research requests in a timely and efficient manner. Work closely with the lines of business and compliance group to update policies to reflect regulatory requirements. Stay up-to-date on industry activities relating to non-default servicing.
Qualification and Experience
Basic Qualifications: A J.D. degree. Must have 8+ years of large law firm or in-house legal department work experience, including 5+ years of experience in focusing upon loan servicing and related regulatory matters and 2+ years of experience managing other attorneys. Must be a licensed attorney, active and in good-standing in at least one State Bar; 5 years of large law firm or in-house legal department work experience, with at least 4 years focused on mortgage and regulatory matters. Preferred Qualifications: 10-15 years of experience in an in-house legal department or other work setting in which candidate supported clients in the mortgage industry. 8-10 years of experience with mortgage regulatory matters. 5 years of experience managing other attorneys. Knowledge of mortgage origination and servicing processes. Expert knowledge of mortgage lending regulatory laws and regulations - both federal and state. Proficiency with computer skills in Microsoft Office, PowerPoint, and Excel. Excellent verbal and written communication skills. Ability to manage large volumes of work and prioritize matters effectively. Ability and willingness to work as a team player. Strong legal research, analytical and organizational skills.
