Workers' Compensation Judge The candidate, under the supervision of the Presiding Workers' Compensation Judge, is assigned to hear and decide judicial matters arising under the Labor Code and California Code of Regulations relating to workers' compensation, Safety Laws, and related laws; involving the duties and responsibilities as required of a Judge of a court-of-record requiring knowledge, study and research in nearly all fields of law; and in addition, thereto. Responsible for reviewing, analyzing and researching to decide law in motion matters, and settlement requests as presented through the Electronic Adjudication Management System (EAMS) and issue orders related thereto. Also responsible for adjudicating through the mandatory settlement and conference calendar those cases that are presented and to assist the parties in resolution by meditating matters in dispute. Review and research those areas of law in which are presented to the judge. Preside over trial matters, admits evidence, rule on objections and prepare a clear record of the presented case. Confirm that the record is properly entered into the EAMS system. Issue orders and decisions in a timely manner as prescribed by the rules.
Qualification and Experience
The candidate should have membership in the State Bar of California and be licensed to practice law in California for 5+ years, 2+ years of which shall be as an attorney serving on the staff of the Division of Workers' Compensation or Workers' Compensation Appeals Board in a class with a level of responsibility not less than that of an Industrial Relations Counsel OR licensed and experience in the active practice of law in California for 5+ years, in litigation before a trial court or quasi-judicial body involving the interests of adverse parties, 3+ years of which shall be in workers' compensation law OR licensed and experience in the active practice of law in California for 5+more years, experience in workers' compensation law, 3+ years as presiding officer in a judicial or quasi-judicial body; or as a member of a court conducting judicial proceedings; or an administrative body conducting quasi-judicial proceedings; or as a hearing officer. Must have knowledge of: Principles and provisions of the Labor Code pertaining to workers' compensation insurance and safety; leading court decisions in California and the United States Supreme Court on the subject of California Workers' Compensation Law; conduct of proceedings in a trial court, rules of evidence governing such proceedings, and laws relating to serving notices, taking depositions, and issuing subpoenas; medical, physiological, anatomical, and occupational terminology in relation to cases of industrial injury; purposes and organization of the Workers' Compensation Appeals Board and Division of Workers' Compensation; procedure before the Workers' Compensation Appeals Board; legal research methods and performing such research; and underlying philosophy of workers' compensation legislation.
