Senior Director, Assistance General Counsel - IT Health Systems and Cybersecurity Attorney The candidate will provide comprehensive legal counsel on all data privacy and security laws and related regulations in partnership with entrepreneurial IT development leadership. Will provide legal advice on data privacy and security laws and regulations with emphasis on the Health Insurance Portability and Accountability Act of 1996 (HIPAA), the Health Information Technology for Economic and Clinical Health Act (HITECH), and related rules and regulations. Perform IT security regulatory review and analysis with focus on clinical IT systems development. Assist with negotiations of data privacy and security provisions in internal and 3rd party contracts/agreements. Provide general IT health systems and Cyber security advice on clinical IT development issues and HIPAA Security Rule compliance. Partner with IT team to develop consistent processes for compliance with all data security administrative, physical and technical safeguards. Advise on IT Security Policy and Procedure development. Assist IT leadership in the development of IT strategy from the standpoint of IT security regulatory compliance. Provide accurate updates and reporting on IT related regulatory risks to IT and other senior leadership. Coordinate with other legal groups on regulatory, risk, compliance, and operational issues Supervise outside counsel, as necessary. Counsel and support firm executives and other attorneys in developing ongoing legal strategies.

Qualification and Experience

The candidate should have JD degree with 8-10 years of legal experience in healthcare information technology. Prior legal experience in complex regulatory compliance issues is essential. State Bar Admission and good standing is essential. Should have understanding and experience with relevant health care privacy and security issues (i.e., audits, investigations, breach mitigation, etc.) and understanding and experience with IT systems and clinical IT development. Strong communication skills, written and oral is essential.
