Real Estate Counsel The candidate will support the business on all real estate and construction related matters handled by the Legal Department. Duties: Provide legal support and advice to the Americas real estate and construction teams on all real estate and construction related legal matters. This will include handling US and Canada related tenancy / lease matters, concessions, project management, wholesale fit out agreements and construction matters, as well as coordinating with local counsel in Mexico and Brazil on such matters; Assisting on all real estate matters and risk management that supports the commercial and business requirements within the local legal framework; Provide real estate legal advice and act as an escalation point day to day for the Real Estate and Construction teams in the Americas to find solutions to manage real estate matters (appropriately balancing Burberry commercial and reputational requirements); Assisting the business in the development, delivery and maintenance of standard lease and construction templates for the Americas and ensuring on-going compliance with current and pending legal regulation; Interpret changes to US federal and state legislation relating to real estate matters (including States of NY and California), work with local external counsel on changes to local real estate and construction laws across all relevant US States and advise the relevant business teams on the potential implications to their function and any policy/practice amendments required as a result, ensuring these changes are communicated and implemented in a timely and effective manner across the US; Prepare, review and negotiate leases, construction, concession agreements for US and Canada; Manage external counsel on transactions to ensure high quality, commercially focused and cost effective legal advice; Develop and provide on-going training programs for the real estate and construction teams on all related issues in the Americas.
Qualification and Experience
The candidate must possess J.D. from top law school, must be admitted to, active and in good standing with the New York State Bar having 3 years major law firm and/or corporate in-house experience with significant emphasis on real estate law, in particular advising retail tenants. In house experience would be desirable but is not essential. Effective oral and written communication and stakeholder management skills, including the ability to build an environment of trust, and influence others in a way that results in acceptance, agreement or behavior change. Understanding that legal advice goes beyond the law and has the ability to respond creatively and strategically to meet the business needs.
