Attorney IV Duties: Provide legal representation and counsel to the South Carolina Department of Social Services (DSS) as an Assistant General Counsel in the Office of General Counsel. Under general supervision, serve as an attorney within the Office of General Counsel. Provide advice to all levels of DSS officials and staff on questions of policy and operations. Assist with policy development for DSS program areas through review and drafting of policy manual changes and memorandums. Assist with writing of regulations for DSS program areas. Develop and maintain specialized knowledge in areas of foster care, adoption, permanency planning, (and associated Title IVE and Medicaid Funding requirements) and the TANF Program and serves as consultation resource to retained counsel in litigation involving DSS in those areas. Monitor and act as liaison between DSS and outside counsel in Insurance Reserve Fund and other lawsuits for civil damages or injunctive relief. Monitor and interpret federal child welfare policy and participates in the development of state plans and reports for child welfare. Communicate and interact with ACF on child welfare issues. Represent DSS in adoptions when children are legally free and in administrative appeals related to adoptions. Litigate complex and difficult cases for DSS, including trial and appellate cases. Serve on inter-agency teams as Office of General Counsel representative.

Qualification and Experience

REQUIREMENTS: A JD Degree or its equivalent from an accredited law school and 6 years of experience as a practicing attorney or 5 years of experience as a Department of Social Services (DSS) attorney. Must be a member of the South Carolina Bar. Working knowledge of the laws of South Carolina. Knowledge of general case, statutory and common law. Knowledge of judicial and quasi-judicial procedures and rules of guidance, including ethics. Ability to interpret and apply laws in court decisions. Ability to analyze facts, evidence and legal instruments. Ability to express conclusions and arguments clearly and logically.
