Collections Trial Attorney The candidate will be responsible for developing and managing collection actions, acting as lead counsel in highly contested state court actions, defending the company in counterclaims/disputes that arise in collection actions, implementing appropriate legal strategies for trials/hearings, supervising judicial collections personnel, organizing litigation and collection strategies, maintaining records and documents and assisting in the management of outside counsel and management of internal staff. Coordinates, supervises and manages all phases of litigation, including conducting necessary and appropriate discovery, hearings trials, depositions, oral arguments, mediations, arbitrations and similar proceedings. Researches the law applicable to cases or matters; drafts legal documents, pleadings, motions, briefs and opinions as required. Conduct settlement negotiations as necessary. Provides daily direction and guidance to associate attorneys. Reviews policies and procedures and recommends and implements efficient collection practices. Maintains an 'opinions and compliance' database. Maintains electronic data exchange network. Tracks status of litigation and litigation management. Provides direction and supervision; monitors and advises a staff of judicial collectors and outside counsel. Ensures legal compliance with local, state and national laws and regulations regarding the judicial collection of accounts. Provides support to Office of General Counsel with statutory interpretations and implementation. Should have a J.D. degree. Must have 2+ years of related experience and/or trial experience. Familiarity with federal and state laws and regulations related to consumer credit and collections, Fair Debt Collection Practices Act, Truth-in-Lending Act, Fair Credit Reporting Act, and Equal Credit Opportunity Act is required.
