Director/Chief Administrative Law Judge, Adjudication Division Duties: Will be responsible for leading the activities of the Adjudication Division, as well as supervising the administrative law judges (ALJ) and support staff within the Division. Will be responsible for meeting with stakeholders, reviewing pertinent legislation, and occasionally testifying or speaking in public settings. Will also serve as the presiding ALJ and will maintain a caseload comprised of workers’ compensation claims, contested workplace safety cases, employment and discrimination claims, and contested cases in which employers have been penalized for failure to maintain workers’ compensation coverage. Will be required to rule on evidentiary issues and pretrial motions, conduct pre-hearing conferences, issue subpoenas, conduct hearings (which may include written and/or oral testimony and cross-examination), review briefs, and prepare and issue written findings of fact and conclusions of law. Most hearings last between 2-4 hours, although some are scheduled for multiple days. Working effectively with the Labor Commission’s consulting medical experts. Evaluating, planning and directing Division activities. Developing or modifying administrative rules, policies, standards, etc. Reviewing and evaluating organizational effectiveness, goal determination, strategic planning, etc. Making recommendations for improvements. Planning and allocating resources to ensure Labor Commission policies and state statutes are fully implemented and followed. Supervising subordinate personnel including: hiring, determining workload, delegating assignments, training, monitoring and evaluating performance, and initiative corrective or disciplinary action. Interacting with stakeholders, businesses, industry associations, governmental agencies, and legislators regarding rules, statues, and Division processes.
Qualification and Experience
Qualifications: Extensive personnel and program management experience. Experience with workers’ compensation, labor, employment, or occupational safety and health law. Exceptional writing and case management skills. Preference will be given for applicants with 3+ years litigation experience. Knowledge of applicable state and federal laws, rules, regulations and/or policies and procedures. Ability to read, interpret and apply laws, rules, regulations, policies and procedures. Ability to develop and/or implement new policies, procedures, standards and/or rules. Ability to supervise others by assigning or otherwise directing work; conducting employee evaluations, staff training and development; taking appropriate disciplinary or corrective actions; making hiring and termination recommendations; etc. Knowledge of principles, theories, and practice of administrative rulemaking. Ability to assess organizational needs such as staffing, training, security, etc. Ability and experience in facilitating or leading hearings, meetings, teams, or work groups to encourage participation. Experience with principles, theories, rules and procedures of judicial or administrative law. Ability to speak clearly, concisely and effectively. Ability to communicate information and ideas clearly and concisely in writing. Experience in speaking before groups of people. Ability to build mutual trust, respect and cooperation among stakeholders including attorneys, pro se litigants, witnesses, legislators, employees from other State agencies, etc. Ability to deal with parties and cases ethically, fairly and in a manner that shows sensitivity, tact and professionalism.
