Senior Counsel, Litigation The candidate will oversee management of diverse litigation portfolio, including approximately 200 litigated matters in 38 US States and 4 Canadian Provinces. Will provide analysis of litigated matters and evaluation of exposure to senior management. Manage outside counsel to ensure efficient handling and resolution of claims in litigation. Work closely with outside counsel, TPA, Risk team and Group Head of Risk to develop strategy for handling of litigated matters and resolution in timely, efficient and cost effective manner. Coordinate discovery responses to ensure accuracy and consistency across litigation portfolio. Develop standard discovery responses and identify and prepare key company personnel to serve as corporate witness. Strategically manage litigation portfolio to ensure accuracy and consistency of responses across entire country to reduce exposure. Identify areas in which systemic exposures are created by company policy, action/inaction, personnel, etc. Attend and provide insight on Claim reviews and claims review panel. Implement and maintain litigation hold policy. Provide support to field on all litigated matters. Assist in Crisis Management protocol and direct investigation into crisis events as necessary to ensure privileges. Work on the Claims Defensibility Project. Attend mediations, deposition of senior personnel and trials as needed.
Qualification and Experience
The candidate should have a Law degree from an accredited US institution with current membership in good standing with the Illinois Bar. Must have 7-10 years of experience in relevant practice area with a strong background in litigating lawsuits in multiple jurisdictions in the US. Canadian experience is preferred. Experience managing and/or litigating transportation matters is desired. Knowledge of case valuation, reserves formulation and litigation strategy is required. Experience in managing the work of outside counsel, other external legal providers and TPA's is needed. Should have well-developed negotiation skills to negotiate and finalize complex litigation matters and to resolve legal and risk issues. Ability to travel throughout North America is essential.
