Patent Litigation Counsel Duties: Provide proactive, strategic, and cost-effective management of patent litigations and assertions. Factual investigation, witness interviews, and discovery work. Oversight of motion practice, including discovery, summary judgment, and pre-trial. Provide patent analysis for all contexts, including litigation, potential acquisition and licensing. Negotiations with opposing counsel , opposing parties and agreement work. Legal business partner to key product and technology stakeholders. Provide counseling with regard to IP and licensing issues. Effectively manage outside counsel and budgets for matters. Liaison and work with other litigators supporting Marketplaces Business Unit. Supervise litigation paralegal.
Qualification and Experience
Requirements: J.D. Degree or equivalent degree, with state Bar membership in more than one state. USPTO registration a plus. 6+ years of experience to support patent litigation and other forms of complex commercial litigation for its Marketplaces Business Unit. 6+ years' litigation experience, whether law firm, in-house or combination of the two. Knowledge of Internet and software technology, whether from previous legal. Negotiations with opposing counsel , opposing parties and agreement work or technical experience. Excellent patent analysis abilities, including development of non-infringement/infringement, invalidity/validity, and claim construction positions. Familiarity with conduct of AIA proceedings. Very good organizational skills and attention to detail, including the ability to prioritize and multi-task and keep everything going smoothly without dropping any balls. Excellent written and oral communication skills, including presentations to senior business and legal personnel. Team player and a sense of humor are essential. Operational mindset; ability to manage/oversee multiple matters at once. Excellent business/technology partnering and client/customer relationship skills.
