Litigation Case Manager Duties: Work with in-house counsels and management to evaluate matters and/or potential matters to seek effective and efficient conclusion. Reduce client exposure through issue identification and process evaluation both internally/externally. Coordinates with business units, acting as a point of contact for the business units, outside servicers, outside agencies, and outside law firms. Perform substantive and procedural legal work as authorized by law and by the client, with independent and discretionary authority, which in absence would otherwise be performed by an attorney or possibly by more senior management. Manage Case Inventory: Receives reviews, analyzes, seeks guidance and/or directs outside counsel regarding all aspects of pre-litigation claims, counterclaims, and/or complaints within a specific inventory. May have direct negotiations with opposing counsels. Manages individual matters from date of notification, service, or filing through resolution. Seeks guidance from management/Sr. Corporate Counsel as necessary and escalates perceived issues/findings as necessary. Said issue may include, but are not limited to, amount sought is above designated authority, claim or legal theory may potentially expose RCS, etal, to liability. Appears as an authorized corporate representative for RCS, etal, as a record's custodian, to testify under oath at live or telephonic trials, hearings, mediations, depositions and/or arbitrations. Appearance as a witness includes, introduction of documents into evidence, explanation of policies and procedures under oath. Review, Verify and Correct Discovery: Coordinates efforts directly with outside counsel for timely and accurate responses to all interrogatories, requests for production of documents, requests to admit, and depositions. Escalates to Sr. Manager and/or Sr. Corporate Counsel subpoenas and deposition requests. May serve as a 30(b)(6) corporate witness. In synchronizing discovery efforts, Litigation Case Managers review, corrects (as necessary) and verifies discovery. When reviewing discovery, takes opportunities to educate outside counsel of errors in an effort to reduce future mistakes and strives to make the entire process more efficient. Investigate, Research and Evaluate Case: Reviews/researches all cases upon service or receipt. Researches issues involved in specific matters, autonomously coordinates with named individuals/entities and with business units to establish root causes. Establishing root causes includes; working within various systems within Resurgent, contacting various business lines and/or subject matter experts, exploring and examining "holes" that may exist within a process that generated the allegations contained within the case, and tendering research findings to management. Identifies areas of potential liability and informs both corporate counsel and outside counsel of findings that may affect overall strategy. Attends meetings and conference calls. Works with outside counsel to schedule or decline appearances based on a criteria of issues to include cost effectiveness, investigation results, legal service/attorney input, etc. Settlement : Coordinates with legal servicer, defense counsel, and/or opposing counsel to settle claims or cases independently within prescribed settlement parameters. Settlement parameters include full autonomy to close an account, limited settlement authority regarding dollar amount and full autonomy to delete a trade line. Reviews settlement agreements with ability to revise the agreement as necessary and execute the same. Insures that all terms of settlement are fulfilled in a timely fashion including, but not limited to, insuring proper accounting information is provided, dealing with credit reporting as necessary, bringing the account to its ultimate status, and insuring prompt payment of settlement funds. Coordinates with servicer when indemnification or contribution is warranted and manages the payment process or recoupment process under the same.

Qualification and Experience

Qualifications: College degree in related field preferred and/or Paralegal degree. 3+ years' experience within the legal field, preferably with a law firm. Functional understanding of pleadings, motions, court orders and discovery required. Experience in CounselLink or other case management software preferred. Strong analytic and organizational skills with acute attention to detail.
