Attorney IV Duties: To administer and coordinate the legal and legislative objectives and activities relating to life, accident and health insurance for the Insurance Department. Responsible for achieving long-range Department life, accident and health regulatory objectives by planning short-term and long-term organizational goals and determining appropriate legislative and regulatory responses to changing market conditions and emerging regulatory issues. Drafts, coordinates and monitors Department-requested legislation concerning the regulation of life, accident and health insurance. Drafts, coordinates and monitors Department rulemaking, bulletins, and other guidance concerning the regulation of life, accident and health insurance. Provides legal counsel to all Department staff, including Consumer Services, Life and Health Market Conduct, Financial Examinations, Licensing, Actuarial and Enforcement on life, accident and health insurance matters. Provides legal counsel to the Commissioner concerning financially impaired life, accident or health insurers and the conduct of any receivership proceeding initiated by the Commissioner under RSA 402-C. Represents the Department before the General Court, on special boards and commissions, at meetings of the National Association of Insurance Commissioners, and other public forums. Serves as legal counsel on special project teams with other Department staff, to carry out Department initiatives relating to life, accident and health insurance, access to insurance coverage, cost containment, reforms, and related matters. Serves as hearing officer at Department administrative hearings as required by the Commissioner.
Qualification and Experience
Qualifications: J.D. Degree from an American Bar Association recognized law school. 6 years' experience in the active practice of law. Must be an active member of the New Hampshire Bar Association and in Good Standing. Thorough knowledge of civil procedure and administrative law. Thorough knowledge of state and federal common, statutory and constitutional law as it affects the regulation of life, accident and health insurance. Familiarity and facility with the major state and federal statutory and regulatory principles in the regulation of life, accident and health insurance. Ability to prepare legal pleadings, briefs and memoranda. Excellent and well developed legal writing and research skills. Ability to render effective decisions and deal tactfully with legislators, state department heads, other public officials, and the public.
