Associate Public Guardian Legal Counsel Responsibilities : The candidate will be responsible for conferring with Associate Public Guardian Legal Counsels (APGLC), Associate Public Guardians, wards/protected persons, plaintiff attorneys, defendant attorneys, and other interested parties to exchange and prepare information on the facts and status of OPG guardianship and conservatorship cases. Researching legal precedents, case reports, and other legal documents to collect information for case preparation; preparing initial drafts of correspondence, motions, pleadings, orders, affidavits and other legal documents; representing the OPG in guardianship and conservatorship legal actions in court, as directed by the Deputy Director of the Office of Public Guardian. Guardian/Conservator duties may include: Coordinating and acting on behalf of eligible incapacitated individuals in day-to-day management of personal and estate matters when the Office of Public Guardian is appointed by the court. Assists in expediting benefits to entitled eligible individuals. Conducts intake interviews; investigates the financial, psychological, family and social histories of referred individuals; plans and arranges for client services and housing in the least restrictive alternative; makes home and facility visits and inspections; assures the care and treatment, to the extent allowable, the intent of the client expressed prior to incompetency; recommends action based on informed consent for medical, surgical and hospitalization; and all other responsibilities as required.
Qualification and Experience
Requirements : The candidate should have a Juris Doctorate from an accredited law college; able to practice law in Nebraska. Baccalaureate degree from an accredited institution with a focus on social work, counseling, psychology, gerontology, related behavioral science, or client support business services and at least two(2) years' experience in a discipline pertinent to the provision of guardianship and conservatorship services which must include decision-making judgment for the benefit of others in the area of legal, guidance and counseling, healthcare, probation and parole, public administration with a focus on developmental disabilities, and/or persons with disruptive behaviors; Education including a supervised field placement or civil clinic law experience providing social casework, counseling, or legal services to elderly, vulnerable or dependent adults, minors and their families. Demonstrated analytical skills with the ability to think logically and arrive at sound conclusions: to identify issues as they arise and address them proactively; to prioritize tasks and accomplish multiple projects simultaneously. Working knowledge of the Office of Public Guardian goals, objectives, and statutory requirements; medical and psychiatric terminology and the symptoms or behavior patterns of persons with dementia, Alzheimer's, and psychiatric problems; ability to research medical issues to facilitate decisions and care plans; and insight to know when to engage second opinions and wider professional team involvement; of principles of social work, sociology and psychology; crisis intervention techniques and principles; casework management methods, organize and prioritize personal/estate case management tasks and assignments; of the techniques of preparing/drafting legal documents and forms; the principles and practices of guardianship and conservatorship administration; judicial procedures and rules of evidence; the principles and practices of legal research; the procedures of trial and administrative hearings. No felony conviction; no misdemeanor conviction involving moral turpitude; possession of a valid Nebraska Motor Vehicle Operator's license or alternate means of transportation; excellent credit history; highest personal and professional references that would support a court finding of suitability to qualify for appointment as a guardian and conservator. Will be subject to an extensive background check.
