Prosecuting Attorney Duties: To ensure fairness and uniformity, firms submitting responses are requested not to contact the general Village Staff or any members of the Village Council. Representation and prosecution of all criminal law matters within the Village’s jurisdiction, including scheduling, coordinating officer appearances, reviewing all criminal cases presented for purposes of prosecution, determination of technical compliance with the Illinois criminal code and other state statutes, preparing complaints, and making recommendations to the Court for alternatives to prosecution where appropriate. Providing advice, consultation, and training where required to the Village, its departments, and staff in the interpretation, investigation, and enforcement of statutes and ordinances in connection with prosecution of criminal cases. Preparation of criminal complaints where facts warrant. Evaluate all cases where a plea of not guilty is entered: Prosecute if warranted. Prepare pre-trial motions or notices if required. Seek additional investigation if required. Negotiate resolutions by plea where advisable. Work with law enforcement and the courts to provide timely court notices to the Village of Dolton Police Department Officers. Representing the Village in all pre-trial proceedings. Performing legal research and preparation of legal briefs where required and advisable. Trying Court and Jury cases. Examination and evaluation of all Appeals to Appellate Courts; Referring matters to the Office of the Illinois Attorney General as necessary. In conjunction with the Office of the IIllinois Attorney General, trying appeals in Appellate Courts where warranted. Providing a monthly report on complaints declined for prosecution and status of complaints prosecuted. Availability to respond to questions as necessary from law enforcement after regular business hours with regard to interpretation of the law. Providing necessary direction to law enforcement regarding investigative techniques which will assist in prosecution. Acting as a resource to the Police Department in the development of criminal cases and provide training sessions for Police staff as needed. Timely preparation and pursuit of disposition of criminal cases in advance of actual Court dates to avoid unnecessary officer court time. Processing and presentation of forfeiture cases on behalf of the Police Department. Providing of an Adjudication hearing officer to preside over the Village of Dolton’s Administrative hearings. Providing the pricing schedule to be used to charge the Village for providing services as outlined in this RFP. Describe how the individual or firm intends to provide legal services, either on an hourly rate, retainer basis, or a combination thereof. Define what type(s) of work you would consider to be extra or specialized work that would be billed in addition to basic services. If you are proposing an hourly schedule, identify the hourly rate of each attorney, paralegal, and support personnel. Identify the minimum increment of time billed for each service, e.g. phone calls, correspondence and personal conferences. Define the type and unit rates for reimbursement for expenses such as mileage, reproduction of documents, faxed documents, and work processing charges. Identify compensation for handling of civil forfeiture cases (e.g. percentage fee).
Qualification and Experience
Requirements: Legal training and number of years of practice, including date of admission to the Illinois Bar, number of years of municipal or other local public section law practice as a full-time local government attorney and/or in a private law office specializing in prosecutions for local government. Professional affiliations. Litigation experience and demonstration of good court track record. Experience in the preparation and review of traffic and criminal ordinances. Note: The retainer agreement shall remain in effect through midnight May 31, 2018. Deadline: 4:30 pm on August 1, 2016
