Attorney II The candidate provides legal advice to Department personnel on wide range of topics, including substantive criminal law, criminal procedure, and statutory/regulatory interpretation. Reviews and revises agency lesson plans, policies, and training materials. Assists in preparing responses to subpoenas and answering discovery requests served on the Department in criminal cases. Maintains, updates, and organizes legal memoranda and internally-distributed legal opinions generated by the Office of General Counsel. Monitors pending legislation and notifies appropriate Department staff of developments involving statutes, regulations, and judicial decisions. Prosecutes various magistrate-level criminal cases and handles all associated appeals to circuit and appellate courts, with an emphasis on DUIs and other offenses under Title 56 of the South Carolina Code of Laws. Other duties as assigned by the General Counsel. Should have Juris Doctor degree or its equivalent from an accredited law school and experience as a practicing attorney. Must have completion of Rule 403, SCACR requirements. Should have knowledge of South Carolina laws, court decisions, and rules of evidence and procedure. A Juris Doctor degree or its equivalent from an accredited law school, with experience as a practicing attorney, and South Carolina Bar membership in good standing is needed.
