Lead Counsel Duties: The candidate will assist the Utility Intervention Unit (UIU) in representing residential and small commercial consumers in utility rate and policy cases and other regulatory proceedings before the New York Public Service Commission (PSC), Federal Energy Regulatory Commission (FERC), and other forums with jurisdiction over New York public utilities. Advocate on behalf of the UIU for reliable utility service at the lowest reasonable cost - particularly for residential and small business customers of public utilities. Draft pleadings, briefs, motions, legal memoranda and comments, advocating the UIU’s positions in rate and policy proceedings. Conduct discovery, undertake cross-examination of other parties’ expert witnesses as well as examination of UIU witnesses, and assist in preparing testimony, in proceedings and litigation. Present oral arguments before PSC and FERC administrative law judges; Conduct negotiations to resolve issues relating to proceedings and meetings before the PSC, FERC and at the New York Independent Systems Operator (NYISO); Represent and advocate for the UIU’s position in meetings and collaborative proceedings; Advocate for the UIU’s position before the appellate courts as required, concerning PSC rate cases and other proceedings, and assist in the development of testimony by experts and consultants in those proceedings; and Assist the UIU Unit to resolve utility-related consumer complaints. Must be either a member of the New York Bar or licensed to practice law in another state having reciprocity with New York State. Additionally, the attorney must have litigation experience in public utility regulation. Excellent writing, analytical and oral advocacy skills are required. Deadline: 03/15/17.
