Counsel II The candidate will perform a wide range of complex legal activities associated with the development, implementation and administration of managed care, accountable care and alternative payment initiatives necessary to support healthcare delivery for Mass Health members. Will be supporting program staff to conduct complex procurements, including for managed care, accountable care alternative payment methods. This includes, but is not limited to reviewing and drafting requests for proposals, contracts, interagency service agreements, and related procurement documents. Reviewing and drafting legal documents, including both regulatory and sub-regulatory interpretive material, and correspondence. Offering advice and risk analysis concerning applicability of and compliance with all federal and state statutes and regulations that may affect firm’s ongoing activities and new initiatives, whether involving program or policy matters, operational issues or spending activities. Providing legal opinions and advice to firm and firm agency program managers and staff on various matters. Maintaining a thorough and comprehensive knowledge of state and federal laws related to Medicaid, state finance and appropriations, and public procurements. Providing legal assistance in responding to requests for public records, subpoenas, and other record requests. Identifying and evaluating potential legal exposures, developing legally defensible alternative courses of action, and assisting clients in formulating creative problem resolutions and strategies. Analyzing the impact and applications of existing, proposed, and developing law on firm and firm agency programs with particular emphasis on the federal Accountable Care Act and related federal regulations and policy guidance. Identifying the need for, and assisting in the drafting of, new legislation and regulations. Representing, and assisting the Attorney General's office in representing, the agency in both affirmative and defensive litigation. Must have a JD degree, admission to the Massachusetts Bar and 3+ years of full-time, or equivalent part-time, professional experience in the practice of law. Applicants must possess excellent communication, writing, legal research, advocacy skills, and good judgment; be self-motivated and diligent workers; have a proven record as a team player; and exhibit strong commitment to public service.
