Foreclosure Attorney The candidate will: Represent Lenders/Servicers in Foreclosure and foreclosure related actions from file referral to Deed. Assist in Review the Law Firm’s Fair Debt letters to borrowers/mortgagors (400+ per year) Review and file Foreclosure Complaint Packages ---Complaints / Notice of Intent to Foreclose/Affidavits of Debt/Affidavits of Notice of Intent Debt affidavits Loss Mitigation Affidavits/Lienholder’s Notices Review Service Returns as needed. Review and approve Judgment Packages and associated Affidavit(s) Review and file Writs of Levari Facias Review and approve Notices of Sale. Communicate with Lenders/Servicers regarding legal issues on Foreclosure related matters Communicate with borrowers and borrower’s counsel in foreclosure/mediation actions order to resolve contested issues. Respond to client questionnaires and surveys on Legal issues related to Delaware foreclosure Provide legal oversight and support to staff and paralegals for the Delaware foreclosure process. Attend Court hearings in Sussex and Kent Counties as needed for foreclosure/eviction and litigated matters.. Attend Foreclosure Related Sales in Accomack County/Northampton County Virginia as needed. Commute to Leesburg as needed for Delaware Team Meetings/Firm Meetings/ HR Training/ and reviewing pipeline data with management. Review Foreclosure Sales Packages and attend Sherriff’s Sales in Sussex and Kent counties on behalf of Servicers/Lenders. Resolve litigated/contested matters including: Summary Judgment/Quite Title Actions/Title issues/ Declaratory Judgment actions/ Reformation of Mortgages/ Release of Judgments/Motions to Appoint GAL. Attend the Court hearings as necessary on these matters as well as assist outside title counsel on title related matters. Track time for both default and contested matters in case system. Review Title and Title Related documents for Deeds in Lieu of Foreclosure. Communicate with Client and borrowers to resolve DIL issues. Represent Lenders/Servicers at Foreclosure Mediations each month in Kent and Sussex Counties (25 to 30 Mediations in each Jurisdiction). Review loss mitigation documents and loan activity, address borrower/HUD Counselor’s concerns, and resolve mediations in a timely manner. Communicate with Lenders’ assigned representative and provide timely updates to both internally and externally. Handle Real Estate Closings related to REO matters (10-12 per year). Review and file Eviction matters on behalf of Lenders/Servicers in Delaware. DE Bar License is a must.
